520 Ringkasan/Abstrak/IntisariTesis ini menganalisa frasa dan mengurai praktek Persetujuan Dewan Perwakilan Rakyat (DPR) atas penetapan peraturan pemerintah sebagai pengganti undang-undang (perpu) pada Pasal 22 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, yang disusun dengan menggunakan metode doktrinal. Persetujuan DPR atas penetapan perpu merupakan bentuk pengawasan DPR atas tindakan presiden dalam upaya pelindungan keselamatan negara dalam keadaan genting yang memaksa. Pengawasan DPR ini bertujuan untuk mengontrol regulatory powerpemerintah sehingga pemerintah tidak bertindak sewenang-wenang dalam membentuk peraturan perundang-undangan yang memiliki dampak terhadap hak-hak masyarakat. DPR dalam praktek pemberian persetujuan atas penetapan perpu tidak melakukan pembahasan pasal-pasal perpu bahkan lebih sempit lagi persetujuan oleh DPR didasarkan pada point-point pemaparan yang disampaikan oleh perwakilan presiden tanpa melihat muatan dan norma pengaturan perpu. Persetujuan atas penetapan perpu oleh DPR semestinya tidak saja dilakukan berdasarkan pemaparan urgensi pembentukan perpu namun juga harus melalui pembahasan terhadap substantif normatif perpu melalui mekanisme pembahasan Daftar Inventaris Masalah sebagaimana pembahasan rancangan undang-undang dilaksanakan. ......This thesis analyzes the phrase and elaborates the practice of the House of Representatives (DPR) approval of the stipulation of government regulations in lieu of laws (PERPU) in Article 22 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, which is prepared using doctrinal methods. The DPR's approval of the PERPU is a form of DPR supervision over the president's actions as a way to protect the country in a state of urgency. The DPR's supervision aims to control the government's regulatory power so that the government does not act arbitrarily in forming laws and regulations that impact on people's rights. The DPR in the practice of giving approval for the stipulation of PERPU does not discuss the articles of PERPU, narrowly the approval by the DPR is based on the presentation points submitted by the president's representative without seeing the content and regulatory norms of PERPU. Approval of the establishment of PERPU by the DPR should not only be based on the presentation of the urgency of the establishment of PERPU but also must go through a discussion of the substantive normative PERPU through the mechanism of discussing the Problem Inventory List in the discussion of the draft law is carried out.
