| 520 Ringkasan/Abstrak/Intisari | Negara-negara di dunia umumnya menetapkan upah minimum dengan dua model, melalui perundingan atau formula matematika. Indonesia menggunakan model perundingan sejak tahun 2003, namun sejak 2015 beralih ke model formula yang kemudian direvisi bentuk formulanya melalui PP 36 Tahun 2021. Melalui metode Delphi, penelitian ini ingin mendapatkan konsensus dari para pakar di bidang ketenagakerjaan tentang efisiensi model formula dalam PP 36/21 dibandingkan dengan model perundingan. Teori transaction cost economics digunakan untuk menilai efisiensi dari dimensi waktu, koordinasi dan pencegahan perselisihan. Penelitian ini menemukan bahwa terjadi konsensus dari mayoritas pakar bahwa model formula matematika lebih efisien dibanding model perundingan. Efisiensi ini didapat pada biaya ex-ante, yaitu dari penggunaan data BPS dan penghapusan peran kepala daerah. Tetapi konsensus pakar tidak tercapai terkait risiko perselisihan di masa mendatang sebagai biaya ex-post dari model matematika. Sebagian pakar menilai risiko perselisihan pada model matematika lebih kecil karena dihapusnya perundingan, tapi sebagian lainnya menilai risiko perselisihan lebih besar karena model matematika menyebabkan upah minimum tidak naik di beberapa daerah disebabkan adanya batas atas dan dihapusnya upah minimum sektoral.
......Setting the minimum wage can be done with negotiation or mathematical formula. Indonesia has used the negotiation model since 2003 and then upshift to a mathematical formula starting in 2015, in 2021 the formula revised by Government Regulation Number 36/2021. This study aims to get expert elicitation to assess the efficiency of the formula model compared to the negotiation model. The theory of transaction cost economics is used to assess the efficiency of time, efficiency of coordination and dispute prevention. This study find that a concensus of a majority of expert was reached on the idea that mathematical formulas model is more efficient compared to the negotiation model. The use of BPS data and the elimination of the role of the regional heads can improve efficiency. However, a concensus was not reached regarding the risk of future disputes that is the ex-post cost of the formula model. Some experts believe that the risk of future dispute resulted from the use of the mathematical model is lower due to the abolition of the negotiations, yet some believe that it could be higher due to the fact that the minimum wage will not increase in several regions as there will be the upper limit of minimum wage and the abolition of sectoral minimum wages. |
