| 520 Ringkasan/Abstrak/Intisari | Ketiadaan pengaturan insolvency test dalam UU No. 37 Tahun 2004 menyebabkan beberapa permasalahan, misalnya debitor yang melakukan permohonan PKPU secara voluntary petition untuk restrukturisasi utang, nyatanya berakhir pada pernyataan pailit terhadap dirinya, sebagaimana yang terjadi pada PT Alamsari Lestari (PT AL). Oleh sebab itu penelitian ini memiliki fokus terhadap dampak yang ditimbulkan akibat ketiadaan insolvency test sebagai persyaratan pailit, baik itu yang dimulai dari PKPU maupun pailit itu sendiri. Selain daripada itu, fokus lanjutan dari penelitian ini adalah analisis model insolvency test yang sesuai terutama ketika terjadi voluntary petition. Penelitian dilakukan dengan metode hukum doktrinal, dengan pendekatan peraturan perundang-undangan, putusan, maupun perbandingan dengan US Bankruptcy Code dan UK Insolvency Act 1986. Hasil daripada penelitian ini adalah PT AL yang memiliki nilai kontinjensi dan prospektif tidak menjadi pertimbangan oleh majelis hakim sebab proposal perdamaian ditolak oleh kreditor berdasarkan Pasal 281 dan 289 UU No. 37 Tahun 2004. Selanjutnya, untuk model insolvency test untuk penilaian solvabilitas yang sesuai dengan karakteristik UU No. 37 Tahun 2004 adalah kolaborasi antara balance-sheet test dengan altman z-score test.
......The absence of insolvency test regulation in Law No. 37 Year 2004 has caused several problems, for example, debtors who apply for PKPU voluntarily petition for debt restructuring, in fact end up declaring themselves bankrupt, as happened to PT Alamsari Lestari (PT AL). Therefore, this research focuses on the impact caused by the absence of the insolvency test as a requirement for bankruptcy, both starting from PKPU and bankruptcy itself. Apart from that, the further focus of this research is the analysis of the appropriate insolvency test model, especially when voluntary petition occurs. The research was conducted using doctrinal legal methods, with an approach of regulations, decisions, and comparisons with the US Bankruptcy Code and the UK Insolvency Act 1986. The result of this research is PT AL which has contingent and prospective value is not taken into consideration by the panel of judges because the peace proposal is rejected by creditors based on Articles 281 and 289 of Law No. 37 Year 2004. Furthermore, the insolvency test model for solvency assessment that is in accordance with the characteristics of Law No. 37 Year 2004 is a collaboration between the balance-sheet test and the altman z-score test. |
