Indonesia memiliki banyak pulau (+ 17.500 pulau) dan sebagian besar adalah pulau-pulau kecil yang banyak mengandung kekayaan alam berupa tambang mineral, kekayaan laut, maupun keindahan alam yang sangat potensial untuk pembangunan ekonomi sehingga banyak pihak yang berkepentingan menginginkan pulau-pulau tersebut bahkan oleh pihak asing, beberapa pihak sangat mengkhawatirkan penguasaan pulau-pulau tersebut oleh pihak asing, karena dianggap akan membahayakan Integrasi dan Kedaulatan negara kesatuan Republik Indonesia. Kita masih trauma dengan direbutnya Pulau Simpadan dan Ligitan oleh Negara Malaysia. Pulau Bidadari yang merupakan salah satu dari 300 gugusan pulau yang ada di Nusa Tenggara Timur saat ini dikuasai Ernest Lewandowski warga negara Inggris, selaku kuasa dari PT. REEFSEEKERS KATHERNEST LESTARI telah memperoleh Hak Guna Bangunan dari Kepala Kantor Pertanahan Kabupaten Manggarai Barat sesuai surat Keputusannya tanggal 23 Mei 2005 Nomor 01/550.2/24.16/2005 dan telah diterbitkan sertifikat Hak Guna Bangunan Nomor 17 Labuan Bajo. Permasalahannya adalah apakaah penguasaan Pulau Bidadari oleh PT. REEFSEEKERS KATHERNEST LESTARI sah menurut hukum? Bagaimana proses pemberian Hak Guna Bangunan kepada PT. REEFSEEKERS KATHERNEST LESTARI; PT. REEFSEEKERS KATHERNEST LESTARI memasang rambu-rambu larangan bagi penduduk setempat memasuki Pulau Bidadari, apakah pemasangan ramburambu larangan tersebut diperkenankan. Dengan menggunakan metode penelitian yuridis normatif dan metode pengumpulan data studi dokumen dilengkapi wawancara dengan masyarakat dan pejabat pertanahan setempat diperoleh kesimpulan bahwa penguasaan Pulau Bidadari oleh PT. REEFSEEKERS KATHERNEST LESTARI adalah sah menurut hukum pertanahan karena subyeknya memenuhi syarat sebagai badan hukum Indonesia yang boleh mempunyai hak guna bangunan, dan tanahnya diperoleh secara sah berdasarkan penyerahan dari H. Yusuf yang selanjutnya telah diberikan Hak Guna Bangunan yang bukan merupakan keseluruhan pulau dan bukan sepadan pantai sehingga tidak melanggar ketentuan pasal 60 Peraturan Pemerintah Nomor 40 Tahun 1996 yis Surat Edaran Menteri Negara Agraria/Kepala Badan Pertanahan Nasional tanggal 3 Juni 1997 Nomor 500-1197 dan tanggal 14 Juli 1997 Nomor 500-1698. Proses pemberian haknya karena dilaksanakan oleh pejabat yang tidak berwenang menurut Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional Nomor 3 tahun 1999 maka Surat Keputusan Pemberian Hak Guna Bangunan atas nama PT. REEFSEEKERS KATHERNEST LESTARI harus dibatalkan. Pemasangan rambu-rambu larangan masuk bagi penduduk setempat adalah melanggar hukum sehingga pemasangan rambu-ramhu tersebut hares dilarang.

Indonesia is the home of vast archipelago consisting of many islands (approximately 17,500 islands), the most of which are minor islands containing vast amount of natural resources and beauty, which are potential particularly for the economic development. Despite the positive side, it nevertheless also brings about other less desirable consequence such as the intention of many parties to possess them privately for the sake of their own interest, some of which are even the foreigners. There are people who worried about this condition, especially recalling what just happened between Indonesia and Malaysia regarding the Sipadan-Ligitan dispute, one of the cases of which considered as threat to our sovereignty. Pulau Bidadari, one of three hundred islands stretched in the region of East Nusa Tenggara, currently is under the possession of an Englishman named Ernest Lewandowski, as the representative of PT REEFSEEKERS KATHERNEST LESTARI who has attained the concession right from the Chief of Land Office of the Western Manggarai District, referring to the Decision dated at May 23`d 2005 No.01/550.2/24.16/2005, and the follow up of which is the issuing of the Certificate of Structure Concession No.17 from Labuan Baja. This research is conducted to find out whether the concession is legally appropriate, particularly with respect to the Land Law? How was the process that eventually Ieads to the issuing of the certificate, and whether the act to put the signs prohibiting the native people to cross is appropriate through the legal point-of-view? Based on the physical research and written data gathered by the writer, within this research will be analyzed several matters as follow: the concession right owner, the possession, the process of the issuing of the concession right, related to the local official who granted it as well as the implementation of the law concerning the transfer of possession right of a land which is part of the whole area on the coast-bordered land (Article 60 of the Government Law No.40 Year 1996 elaborated in the Circular Letter of the State Minister of Agrarian Affairs/ the Chief of National land Bureau dated at June 3rd 1997 No.500-1197 and July 14th 1997 No. 500-1698. In this thesis it is also elaborated the matters concerning the prohibition signs for the native people to cross into the Pulau Bidadari area, with respect to the applicable law.
