Latar belakang penulisan tesis ini adalah dijadikannya tanah fasilitas sosial dan fasilitas umum yang telah slap bangum yang diperuntukan untuk keperiuan masyarakat lingkungan perumahan Harapan Indah kota Bekasi Jawa Barat menjadi lokasi proyek pembangunan komplek pertokoan atau rumah toko oleh pihak perusahaan pembangunan perumahan, dan yang menjadi pokok permasalahannya adalah 1. Apakah pembangunan komplek pertokoan diatas tanah fasilitas sosial data fasilitas umum yang terjadi sesuai dengan peraturan perundang-undangan yang berlaku? dan 2. Apakah dengan pembangunan komplek pertokoan tersebut maka hak masyarakat atas fasilitas sosial dan fasilitas umum telah terpenuhi?.Metode penelitian yang dipakai dalam tesis ini adalah metode penelitian kepustakaan dengan mengunakaa alat pengumpulan data berupa studi dokumen dengan tujuan uatuk mengumpulkan data sekunder dalam bidang hukum yang terbagi dalam berbagai jenis seperti sumber primer berupa Peraturan Dasar yaitu Undang-Undang Dasar 1945. Peraturan perundang-undangan yang terkait dengan permasalahan, seperti UU Nomor: 5 Tahun 1960, UU Nomor. 4 tahun 1992, PMDN Nomor. 1 tahun 1987, PMDN Nomor. 3 tahun 1987, Perda Kota Bekasi Nomor .77 Tahun 1999. Sumber sekunder berupa Buku, makalah, laporan penelitian dan Tesis, sedangkan sumber tarsier adalah petunjuk geograpis dll.Data yang ada diolah menggunakan pendekatan kualitatif maka kesimpulan yang didapat bahwa pembangunan komplek pertokoan yang terjadi telah melanggar peraturan perundang-undangan yang berlaku serta bangunan komplek pertokoan tersebut bukan merupakan hak dari penghuni perumahan atas fasilitas sosial.

The background of writing this thesis is the conversion of land for social and public utilities for Harapan Indah Residential Community in Bekasi City into location of 'shopping project or Semi Residential Complex by the Land Developer. And the core problems in this case are: (1) whether the construction of shopping complex on such social & public utility land complies with the prevailing laws; (2) whether with the construction of such shopping complex, the residential community's rights upon the social & public utility land have been fulfilled.The method used in writing this thesis includes library research, that is collecting documentary studies as secondary data in legal aspects, which consist of primary resources such as the Constitution and other laws relevant to the problems, including Law No. 5 of 1960, Law No. 4 of 1992, Decree of Minister for Domestic Affairs No. 1 of 1987, Decree of Minister for Domestic Affairs No. 3 of 1987, and Regional Regulation of Bekasi City No. 77 of 1999. Secondary resources include books, articles, research reports and thesis, while tertiary resources include geographic mapping, etc.The data collected with qualitative approach shall conclude that the construction of shopping complex in social and public utility land has breached the prevailing laws and that the shopping complex constructed do not belong to the residential community who deserve to get the social & public utilities.
