Tesis ini membahas mengenai efektivitas dari Peraturan Daerah Khusus Ibukota (DKI) Jakarta Nomor 6 Tahun 1999 (Perda Nomor 6 Tahun 1999) mengenai Rencana Tata Ruang Wilayah 2010 dikaitkan dengan kebutuhan akan tanah pemakaman. Ternyata keterbatasan tanah bukan terjadi bagi orang yang hidup saja akan tetapi berlaku pula bagi orang yang sudah meninggal. Besarnya angka kematian dalam setiap harinya dan kebutuhan akan tanah pemakaman yang terbatas di wilayah DKI Jakarta ditekankan dalam penulisan ini. Dalam Perda tersebut diatur mengenai Persentase Ruang Terbuka Hijau yang ditargetkan untuk DKI Jakarta sampai tahun 2010, dimana tempat Pemakaman merupakan salah satu klasifikasi dari Ruang Terbuka Hijau.
Tempat Pemakaman dalam Pasal 14 Perda Nomor 6 Tahun 1999 di kategorikan sebagai kawasan hijau binaan sedangkan dalam Pasal 5 dan Pasal 1 ayat (19) Peraturan Menteri Dalam Negeri (PMDN) 1 Tahun 2007 tentang Penataan Ruang Terbuka Hijau Kawasan Perkotaan merupakan Ruang Terbuka Hijau Kawasan Perkotaan (RTHKP) Publik. Dalam Pasal 14 ayat (5) Perda Nomor 6 Tahun 1999 diatur bahwa kawasan yang termasuk dalam bagian kawasan hijau binaan tidak dapat diubah peruntukannya dan Pasal 12 ayat (3) PMDN juga dijelaskan bahwa RTHKP Publik tidak dapat dialih fungsikan. Penelitian ini adalah penelitian hukum normatif dan empiris dengan tipologi penelitian deskriptif analitis.
Hasil dari penelitian dilapangan terdapat penyimpangan terhadap Perda Nomor 6 Tahun 1999, Pasal 14 ayat (5) dan Pasal 12 ayat (3) PMDN, salah satunya Perubahan peruntukan sebagian tanah pemakaman yang menjadi areal hunian dan non hunian milik swasta, yakni TPU Menteng Pulo, Tebet, Jakarta Selatan yang ditukar oleh pemerintah dengan pihak swasta dengan cara ruilslag atau tukar guling.
Banyak pertimbangan pemerintah memberikan izin perubahan peruntukan tersebut akan tetapi hasil penelitian menyarankan agar pemerintah konsisten terhadap Perda nya dan lebih selektif dan bijak dalam memberikan izin perubahan peruntukkan lahan terutama apabila tanah tersebut sebelumnya merupakan bagian dari urgensi kepentingan umum. karena pemberian izin yang menyimpang dengan RTRW dikenakan sanksi pidana dan apabila Perda tersebut dianggap sudah tidak dapat memenuhi perkembangan kota DKI Jakarta baiknya Pemerintah meninjau kembali dengan merubah atau merevisi Rencana Tata Ruang Wilayah (RTRW) atau Perda tersebut.
This thesis discusses the effectiveness of the Regulation of the Special Region of the Capital City of Jakarta Number 6 of the Year 1999 (Local Government?s Regulation Number 6 of the Year 1999) regarding the regional spatial planning of 2010 linked to the needs of cemetery area. Apparently the scar city of land is not only towards the living but it is also applicable to the dead. The mortality rate each day and the needs of limited cemetery area in the territory of the Special Region of the Capital City of Jakarta are emphasized in this thesis. In the Local Government?s Regulation, it is stipulated that the percentage of Green?s Opened Spaces which is targeted for the Special Region of the Capital City of Jakarta up to the year 2010, in which cemetery Area constitutes one of the classifications of Green?s Opened Spaces.
Cemetery Area in Article 14 of the Local Government?s Regulation Number 6 of the year 1999 is categorized as fostered green zone, whereas in Article 5 and Article 1 paragraph (19) of the Regulation of the Minister of Domestic Affairs no. 1 of the Year 2007 regarding the Structure of Green?s Opened Space of Urban Area, it constitutes Public Urban Area?s reen?s Opened Spaces. In Article 14 paragraph (5) of the Local Government?s Regulation Number 6 of the Year 1999, it is stipulated that zones included in fostered green zones cannot be changed/replace with regard to its allocation and in Article 12 paragraph (3) of the Regulation of the Minister of Home Affairs, it is normative and empirical law research with descriptive analitycal research?s typology.
From the result of field research, there are difference between the Local Government?s Regulation Number 6 of the Year 1999, Article 14 paragraph (5) and Article 12 paragraph (3) of the Regulation of the Minister of Home Affairs, one of them is the change of allocation of parts of cemetery area to become privately owned residential and non residential area, which is Menteng Pulo Public Cemetery Area, Tebet, South Jakarta, which is replaced by the government and the private party by menas of exchange or swap.
There are many considerations of the government in granting such permit for the change of allocation, however, the result of research suggests that the government should be consistent with is own Local Government?s Regulation and should be more selective and wise in granting permit for the change of allocation of area, especially if such area previously constitutes a part of public interest urgency, because the granting of permit which is deviating from Local Spatial Planning will be penalized by criminal sanction and if such Local Government?s Regualtion is no longer considered accommodating the urban development of the Special Region of the Capital city of Jakarta, it would be better that the Government review it by menas of amending or revising the Local Spatial Planning or such Local Government Regulation.
