Pada saat ini di Indonesia banyak terjadi masalah pertanahan guna menjamin kepastian hukum, maka pemerintah menyelenggarakan pendaftaran tanah untuk memberi perlindungan hukum kepada pemegang hak atas tanah. Salah satu yang menjadi permasalahan dibidang pertanahan adalah sengketa mengenai kepemilikan hak atas tanah. Penelitian ini bersifat deskriptif analitis yaitu dari kepustakaan serta merujuk dari putusan-putusan yang menggambarkan mengenai kegiatan pendaftaran tanah beserta berbagai permasalahan disekitarnya. Sistem publikasi negatif yang bertendens positif, yaitu sertipikat hanya merupakan alat bukti hak yang kuat dan bukan merupakan alat bukti hak yang mutlak.

At this time in Indonesia, many land problem occur in order to ensure legal certainty, therefore, the government is administering the registration of land to give legal protection to the holders of land rights. One of the problems in the field of land is a dispute regarding ownership of land rights. This research is descriptive analytic of the literature and the refer the decision that illustrate the activities of registration of land and the surrounding issues. Negative publicity system that is intended to be positive, which is the certificate, is only a strong proof of evindence but it does not constitute an absolute proof of evindece.
