Mekanisme pemungutan royalti lagu belum diatur dalam Undang-Undang No. 19 Tahun 2002 tentang Hak Cipta (UUHC), namun dalam pelaksanaannya, pemungutan royalti tersebut mengacu pada standar baku yang dibuat YKCI yang merupakan suatu organisasi profesi yang mengelola pengadministrasian kolektif khususnya di bidang lagu atau musik yang sangat berperan dalam pengeksploitasian hak cipta lagu atau musik bagi pencipta, pemegang hak cipta, artis organisasi siaran maupun produser rekaman, terutama dalam pemungutan dan pembagian royalti atas hak pengumuman (performing right). Penerapan mekanisme pemungutan royalti oleh YKCI juga masih mengalami banyak kendala dan pelanggaran. Oleh karena itu penulis berpendapat perlu adanya penambahan regulasi mengenai royalti atas lagu dan collecting society yang berwenang mengelola pengadministrasian kolektif atas royaltinya, sehingga hak cipta lagu dapat dilindungi dalam pengeksploitisasinya secara komprehensif.
Mechanism on collecting song?s royalties have not been regulated in Law No. 19 of 2002 about Copyrights, but in the implementation, collection of song?s royalties is referring to the standards that made by Yayasan Karya Cipta Indonesia (YKCI) who is a professional organization that managed by collective administration, especially in the field of song or music that is instrumental in exploiting copyrighted songs or music for creators, copyright holders, artists, and record producers, and also broadcasting organizations, especially in the collection and distribution of royalties for the performing rights. Application of royalty?s collection mechanisms by YKCI also still has many obstacles and violations. Therefore, the authors suggest the need for additional regulation of the royalties on songs and also the collecting society which competent to manage the collective administration of royalties, so the exploitation of song's copyright can be protected in a comprehensive manner.
