Notaris adalah pejabat umum yang diberi kewenangan oleh undang-undang dan kepercayaan dari masyarakat untuk menjalankan sebagian kekuasaan negara untuk membuat alat bukti tertulis yang otentik dalam bidang hukum perdata. Aktaotentik yang dibuat oleh Notaris mempunyai kekuatan pembuktian yang sempurna serta memberikan kepastian hukum. Karenanya Notaris dalam melaksanakan jabatannya harus berlandaskan pada sumpah jabatan serta Peraturan Jabatan dan Kode Etik Profesinya. Namun pada kenyataannya, adapula notaris yang melanggar sumpah jabatan serta Peraturan Jabatan dan Kode Etik Profesinya sehingga menimbulkan problematika hukum. Problematika ini dapat muncul pada saat notaris memangku jabatannya atau ketika notaris memasuki masa purnabakti.
Tujuan penelitian yakni untuk mengetahui tanggung jawab notaris terhadap gugatan pihak ketiga setelah berakhir masa jabatannya serta bentuk-bentuk gugatan yang akan dilakukan oleh pihak ketiga dan perlindungan hukum bagi notaris terhadap gugatan pihak ketiga setelah berakhir masa jabatannya.
Metode penelitian dalam penulisan ini adalah yuridis normatif yang menekankan pada norma-norma hukum dengan menganalisa peraturan perundang-undangan terkait dengan jabatan notaris serta peraturan- peraturan lain yang mendasarinya.
Berdasarkan Pasal 65 Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris bahwa Notaris bertanggung jawab atas akta yang dibuatnya meskipun protokol notaris telah diserahkan atau dipindahkan kepada pihak penyimpan protokol notaris. Ini berarti bahwa tanggung jawab notaris terus melekat pada pribadi purnabakti notaris. Berakhirnya masa jabatan notaris tidak mengakhiri tanggung jawab purnabakti notaris atas perbuatan hukum yang dilakukan semasa jabatannya.
Notary is a public officials who was given authority by the law and trust from public for function most of the state authority to produce an authentic written evidence in the field of civil law. Authentic deed which made by Notary have the strength of authentication that was perfect as well as give the certainty of law. Therefore, Notary in implementing the position must be build upon the fundamental commitment, regulations and also Profession Ethic?s Code. But in fact, there are also notary who was against the regulation, fundamental commitment and Code of Ethics, giving rise to the problem of the legal profession. Those problems could emerge during the notary in charge or even when they were enter a retired period.The purposes of this research are to determine the responsibilities of a notary to the third-party lawsuit after the end of his tenure and other forms of action to be performed by third parties and legal protection for the notary to the third party lawsuit after the end of his tenure.The method of this research is using a library analysis reference method with juridicial normative approach.Based on Article 65 of Law Number 30 Year 2004 about the Position of Notary that the Notary is responsible for the deed he made even though the notary protocol has been submitted or transferred to the depositary notary protocol. This was significant, that the notary responsibilities attached in the personal retired notary. Thus, expiration of notary?s office term does not end the responsibility for the actions who performed by notary during his tenure.
