Dalam perceraian terdapat unsur penegakan hukum materil dan formil. Hukum formil dalam perceraian bersifat prosedural dan termasuk bagian dari hukum acara yang mengatur untuk ditaatinya hukum materil yang berlaku perceraian. Semua hal yang bersifat prosedural harus tunduk kepada lex fori. Namun demikian, terdapat kompetensi khusus pada perceraian yang memiliki unsur asing terutama dalam menentukan yurisdiksi Pengadilan. Unsur asing tersebut juga akan mempengaruhi aspek-aspek hukum acara yang seharusnya tunduk pada lex fori. Skripsi ini membahas mengenai aspek-aspek hukum acara perdata internasional yang dapat timbul dalam masalah perceraian. Metode penelitian yang digunakan adalah metode penelitian normatif dengan hasil bahwa dalam perceraian, aspek hukum acara perdata internasional yang terpenting untuk menentukan adanya yurisdiksi dari pengadilan setempat untuk mengadili perceraian tersebut. Apabila telah ditentukan adanya yurisdiksi maka pengadilan dapat menerapkan aspek-aspek hukum acara perdata yang terkait.

Abstract
When applying settlement of divorce, there are two elements need to be nforced which is substantive law and procedural law. Procedural law is a way to warrant the compliances of the substantive law. Every aspects of procedural law are subject to lex fori which allow the law of the judge to apply in the court. However, there is particular competence in determining jurisdiction of the court to settle divorce matter. The foreign elements of divorce will also affect aspects of procedural law that should be subject to lex fori. In this thesis, there will be explanations of the legal aspects in international civil procedure that may arise in divorce settelement cases. The result leads to the most important thing in settlement of international divorce is to determine the jurisdiction of the court. If so, the court can apply all the related aspects of international civil procedure in divorce cases.
