The author does analyze by considering Savigny's thought which said that law is social reality. But in this study suggested due to legislation through syariah banking in Indonesian 's society needs also anticipation towards legal consciousness regarding bank interests. lt's aimed to reach unify thought 's both lawyer and scholar of Islam to finding harmony. Rooted on the aspect of legal culture the Indonesian society is more familiar on unwritten law. Based on those circumstances the author has thought that needs through syariah banking regulation?s approach by under law (government regulation) levels which in detail governs work mechanism and everything relating to its role.
