Skripsi ini membahas mengenai tiga hal, yaitu perlindungan hukum bagi konsumen apartemen pada saat tahap pratransaksi, transaksi, dam purnatransaksi; kedudukan brosur dan site plan sebuah apartemen sebagai salah satu hak informasi konsumen apartemen, dimana hingga saat ini masih terjadi pengaduan yang dilakukan oleh konsumen apartemen kepada YLKI berkaitan dengan hal tersebut dan timbul pertanyaan apakah brosur dan site plan tersebut mengikat sebagai sebuah hak informasi konsumen apartemen; serta membahas aspek perbuatan melawan hukum dalam kasus gugatan Linawaty Tjhang melawan PT. Sunter Agung Real Estate Development & Construction. Aspek perbuatan melawan hukum yang diteliti adalah bagaimana pertanggungjawaban developer terhadap perbuatannya yang telah melakukan hal-hal yang tidak tercantum di dalam brosur dan site plan sebuah apartemen sehingga menyebabkan konsumen apartemen mengalami kerugian secara materiil dan immateriil. Penelitian ini menggunakan metode penelitian yuridis normatif dimana data penelitian ini sebagian besar dari studi kepustakaan yang diperoleh. Hasil penelitian ini menyatakan bahwa (1) brosur dan site plan adalah mengikat sebagai hak informasi bagi konsumen apartemen karena brosur dan site plan merupakan janjijanji prakontrak sehingga mempunyai akibat hukum apabila hal ini diingkari; (2) perbuatan PT. Sunter Agung Real Estate Development & Construction yang telah mendirikan bangunan mesin diesel di halaman depan RuKan milik Linawaty Tjhang adalah termasuk suatu Perbuatan Melawan Hukum, dimana hal tersebut tidak tercantum di dalam brosur dan site plan RuKan tersebut dan dilakukan tanpa sepengetahuan Linawaty Tjhang, sehingga hal ini melanggar hak subjektif Linawaty Tjhang sebagai pemilik sah RuKan tersebut.

This thesis is mainly focusing on three problems. First, legal protection for consumers of the apartment at the pre transaction, transactions, and posttransaction. Second, legal standing of the brochure and site plan as one of the information rights of a consumer of the apartment, whereby there are many complaints made by consumers of the apartment to YLKI in regards of this aspect and there is a question arises whether the brochure and site plan are binding as an information rights of a consumer of the apartment; and third, explaining the aspect of tort in the case of lawsuit by Linawaty Tjhang to PT. Sunter Agung Real Estate Development & Construction.

The aspect of tort which observed is the responsibility of the developer who has done some things that are not listed in the brochure and site plan of an apartment, in which causing the consumer of the apartment get material and immaterial losses. This research is a normative juridical research, which some of the data are based on the related literatures.

The result of the research states that (1) brochure and site plan are binding as an information rights of a consumer of the apartment because brochure and site plan are a pre-contract promises so they have legal effect if they are not implemented; (2) the action of PT. Sunter Agung Real Estate Development & Construction which has built diesel engines in the front yard of Linawaty Tjhang's RuKan, involved as tort action, whereby this action is not listed in the brochure and site plan of the RuKan and the diesel engine has been built without Linawaty Tjhang's permission, so this action violates subjective rights of Linawaty Tjhang as a legal owner of the RuKan.
