Bagi sebagian besar TKI , Malaysia merupakan negara tujuan utama dikarenakan
kedekatan kondisi geografis, sejarah dan budaya antara Indonesia dan Malaysia.
Tingginya permintaan atas pekerja rumah tangga (Pekerja sektor domestik) di
Malaysia menjadikan tenaga kerja yang berketrampilan dan berpendidikan rendah
di Indonesia bermigrasi ke Malaysia . Namun sayangnya TKI sektor domestik di
Malaysia rentan terhadap eksploitasi dan pelanggaran hak asasi manusia, hal ini
dapat dilihat dari banyaknya kasus dan permasalahan yang menimpa para TKI
sektor domestik di Malaysia, Tesis ini membahas sejauhmana ketentuan
internasional, ketentuan nasional Indonesia dan Malaysia serta ketentuan dalam
perjanjian bilateral kedua negara tersebut dalam melindungi TKI sektor domestik
di Malaysia.
AbstractMalaysia is the main destination for most of Indonesian domestic workers, due to
a close connection of geographical proximity, historical and cultural between
Indonesia and Malaysia. The high demand for domestic workers in Malaysia
makes low skilled and low educated workers in Indonesia migrate to Malaysia.
Unfortunately, domestic workers in Malaysia are vulnerable to exploitation and
violations of human rights, which can be observed from number of cases and
issues that affect the domestic workers in Malaysia. This research discusses how
international law, the national law of Indonesia and Malaysia and also the bilateral
agreement between the two countries governs the protection of Indonesian
domestic sector workers in Malaysia
