Indonesia setelah ditinggalkan oleh penjajah memiliki ungang-undanga yang mengatur bidang pertanahan yaitu Undang-undang Nomor 5 tahun 1960 tentang Pokok-pokok Agraria kemudian di tahun 1997 lahir Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Kedua peraturan perundang- undangan tersebut diciptakan untuk melindungi dan menjamin kepada rakyat khususnya bagi pemegang hak atas tanah agar status kepemilikan atas tanah tidak tumpang tindih atau terjadi perselisihan /sengketa. Namun kenyataannya yang terjadi di masyarakat banyak sengketa pertanahan khususnya menyangkut kepemilikan baik itu menyangkut identitas pemelik maupun letak dan lokasi tanah. Yang lebih serng terjadi di masyarakat adalah menyangkut identitas pemilik hak atas tanah. Berdasarkan itu Penulis tertarik terhadap study kasus yang dialami oleh MIRSAD SUDARGO di Pengadilan Negeri Cibinong dan YANDIH S di Pengadilan Negeri Tngerang masing-masing terjadi pada tahun 2006, untuk dijadikan sebagai bahan tesis ini. Dalam kedua kasus tersebut diatas kepemilikan hak atas tanah beralih kepada orang lain tanpa diketahui oleh pemiliknya atau si pembeli tanah. Bagaimanan hal itu bisa terjadi? Mengapa Undang-undang Nomor : 5 tahun 1960 dan Peraturan Pemerintah Nomor : 24 tahun 1997 tidak bisa melindungi pemegang hak atas tanah. Berdasarkan literatur dan sumber-sumber yang Penulis peroleh dilapangan, Penulis bermaksud memberikan suatu ide atau usulan yang dituangkan dalam tesis ini yang memungkinkan untuk bisa dilaksanakan dengan harapan sengketa kepemilikan hak atas tanah dapat berkurang dimasa-masa yang akan datang.

After being left by colonialist, Indonesia has a law provision regulating the area of land, namely Law Number 5 of 1960 on Basic Agrarian Law; furthermore in 1997 the Government issued a Government Regulation Number 24 of 1997 on Land Registration. Both laws were provided to give protection and assurance for the people, particularly the holders of land rights, so that the status of land ownership will not overlap an resulting in conflicts / disputes. But it turns out that many land disputes occur in society, particularly those pertaining to the ownership, both related to the identity of the owner and the location of the land. The most common problem on society is related to the identity of the owner of land rights. Accordingly, the Author was interested in case studies which were experienced by MIRSAD SUDARGO in Cibinong District Court and YANDIH S in Tangerang District Court, took place in 2006 respectively to be used as the materials of this thesis. In both cases, the ownership of land rights had been transferred to another person without being noticed by the owner or those who bought the land. How did it happen? Why the Law Number 5 of 1960 and Government Regulation Number 24 of 1997 could not protect the holders of land rights. Based on literatures and other sources that obained by the Author from the field, the Author intends to give an idea or suggestions as provided in this thesis which might be implemented, with the hope that land ownership disputes can be reduce in the future.
