 Abstract

Sita jaminan adalah tindakan menempatkan obyek sengketa ke dalam penguasaan pengadilan. Hal ini guna menjaga agar gugatan penggugat tidak menjadi kabur dan sia-sia. Sita jaminan harus dinyatakan sah dan berharga agar dapat mengikat dengan sempurna. Putusan Peninjauan Kembali Mahkamah Agung Nomor 278 PK/PDT/2010 menganalisa mengenai jual beli tanah sita jaminan yang belum dinyatakan sah dan berharga dari Tuan Hengkie Soediono kepada PT. Excelcomindo Pratama, Tbk.
Tesis ini membahas kekuatan sita jaminan yang belum dinyatakan sah dan berharga, keabsahan jual belinya, serta penerapan putusan tersebut terhadap hukum yang berlaku. Tesis ini menggunakan penelitian kualitatif dengan analisa preskriptif. Hasil penelitian menyarankan agar pembeli lebih berhati-hati dalam melakukan jual beli, kantor pertanahan lebih teliti dalam menerbitkan sertipikat dan majelis hakim lebih seksama dalam memeriksa perkara.

Collateral forclosure is a legal action to put the object of dispute under the court custody. It is meant to maintain the plaintiff?s lawsuit from being vain and vague. A collateral forclosure should be declared valid and valuable in order to bind legally and properly. The Supreme Court Decision Number 278 PK/PDT/2010 analyze about the transfer of collateral forclosure that has not been declared as valid and valuable, based on sales and purchase from Mr. Hengkie Soediono to PT. Excelcomindo Pratama.
This thesis analyze about the power of collateral forclosure that has not been declared as valid and valuable, the validity of sales and purchase of the transfer and how the court decision complies with the regulation. This thesis is based on a qualitative research with a prescriptive design. The results suggest that buyer should be a more cautious, the land office should be more thorough in publisihing a land sertificate, and judges should be more accurate in reviewing a legal case.
