ABSTRAK
Tesis ini membahas sengketa tanah di Jakarta Barat antara ahli waris dari pemilik tanah dengan developer. Ahli waris menggugat kepemilikan developer atas sertipikat Hak Guna Bangunan nomor 4067/Kedoya karena ahli waris membantah telah mengalihkan hak atas tanah kepada pihak lain. Sedangkan developer mendapat hak atas tanah tersebut dari pihak lain berdasarkan akta jual beli yang terjadi tahun 1974. Proses peradilan terjadi dari Pengadilan Negeri sampai dengan Peninjauan Kembali. Akan tetapi Hakim dalam pertimbangannya lebih melihat kepada hasil laboratorium krim Dit.Seres MABES POLRI yang menyatakan bahwa cap jempol pada akta jual beli tahun 1974 adalah tidak sesuai dengan cap jempol asli pembanding, seharusnya hal yang perlu diteliti kebenarannya yaitu surat keterangan waris yang mendasari dibuatnya akta jual beli nomor 0025/1974 dan akta jual beli nomor 0026/1974. Dalam penelitian ini menggunakan metode penelitian kepustakaan dengan menggunakan bahan hukum premier dan bahan hukum sekunder yang bertujuan untuk menganalisa kebenaran peralihan hak atas tanah yang dilakukan developer dan bagaimana penyelesaian sengketa akibat dari batalnya akta jual beli nomor 0025/1974 dan akta jual beli nomor 0026/1974. Developer yang telah kalah pada peninjauan kembali tidak dapat melakukan upaya hukum, namun untuk dapat mempertahankan hak atas objek sengketa, dapat melakukan negosiasi terhadap ahli waris.

ABSTRACT
The purpose of this thesis is to review land dispute in West Jakarta between heirs of the land owner and developer. The heirs sued the developer regarding the ownership of certificate Hak Guna Bangunan number 4067/Kedoya. The heirs denied that they have transferred the ownership of land to other parties. On the other hand, developer got the land ownership from another party based on the deed of sale in 1974. The judicial process was conducted from District Court down to Judicial Review in Supreme Court. When the judge in the court reviewed the result of Laboratory of Dit.Serse MABES POLRI, they found out that their thumbprint on the deed of sale in 1974 was not same with the original thumbprint of the heirs. Therefore, an investigation is necessary to be conducted to identify which names in the inheritance letter that were used create the deed of sale number 0025/1974 and the deed of sale number 0026/1974. This thesis is using method of literature research with legal materials premiere and secondary legal materials. It is aiming to analyze the truth oftransferred the land right from the land owner to developer and to find a solution to solve the dispute which was caused by two deeds of sale. Developer who has lost in Judicial Review will not be able to do any legal actions, but will have to retain the rights of land by negotiating it with the heirs.
