Hak budget parlemen dalam sistem bikameral Indonesia dalam rangka mewujudkan Anggaran Pendapatan dan Belanja Negara (APBN) untuk sebesar-besarnya kemakmuran rakyat, belum ditempatkan pada kedudukan yang tepat dan sepadan dari sudut konstitusi (Pasal 23 Ayat 1 Undang-Undang Dasar 1945 Hasil Perubahan), sesuai dengan falsafah kedaulatan rakyat, checks and balances serta tujuan bernegara. Kedudukan Parlemen Indonesia yang terdiri dua kamar (bikameral), Dewan Perwakilan Rakyat (DPR), dan Dewan Perwakilan Daerah (DPD), dimana DPR memiliki peran yang lebih kuat dari pada DPD, karena DPR sebagai lembaga yang membahas dan memberikan persetujuan anggaran, sedangkan DPD hanya sebagai lembaga pemberi rekomendasi, membuat tidak terjadi keseimbangan sistem bikameral Indonesia. Metode yang digunakan dalam penelitian tesis ini adalah penelitian hukum (legal research) untuk mendapatkan deskripsi mengenai hukum yang menyangkut aktivitas pemerintahan yakni Parlemen Indonesia dalam menggunakan hak budgetnya yangdisajikan secara analitis.Hasil penelitian menunjukkan Perubahan UUD 1945 tidak secara tepat mendudukkan hak budget parlemen. Hak budget parlemen diletakkan pada persetujuan APBN sebagai bentuk pengelolaan keuangan negara, yang seharusnya merupakan persetujuan APBN sebagai wujud kedaulatan negara. Kewenangan DPR dan DPD yang tidak seimbang dalam sistem bikameral juga menambah tidak optimal hak budget parlemen tersebut. Selain itu, diperoleh pula faktor-faktor yang menghambat hak budget parlemen dapat berjalan secara efektif mewujudkan APBN untuk sebesar-besarnya untuk kemakmuran rakyat, yaitu faktor kapasitas personal anggota parlemen, kerangka regulasi pembahasan APBN, lembaga pendukung keahlian, sistem kepartaian dan partai politik, proposal APBN dari pemerintah, partisipasi masyarakat, dan Mahkamah Konstitusi.

The parliamentary rights of budget in Indonesia bicameral of system in order to create the National Revenue and Expenditure Budget (state budget) for the prosperity of the people as much as possible, in the placed being in correct position and angle to match the constitution of Law (Article 23 Sentence 1 of the Constitution of Law 1945 revenue Change), according to the philosophy`s popular of sovereignty, checks and balances and the purpose of nationhood. The Indonesia of Parliament position consisting of two room`s (bicameral), the House of Representatives (DPR), and the House of Representative Council (DPD), which would like to the House has a stronger role`s of the DPD, because the House of Representatives as the board discusses and gives approximate agreement, whereas DPD only as the provider of the board recommendations, make unoccur balance bicameral of system of Indonesia. The method used in this thesis is a study of law (legal research) to get a description of the rule of law that concerns activity in the Indonesian Parliament to exercise the right purse presented analytically.

The results showed changes in the 1945 Constitution of law didn`t exactly sitting right parliamentary of budgeting. Right parliamentary of budget placed on the consentrations of the state of budget as a form state financial of management, which should be a state budget agreement as inherent sovereignty. The DPR and DPD authority disproportionate bicameral of system also adds to optimum not right to the parliamentary budgeting. In addition, acquired about the factors that inhibit the parliamentary budget of right can run effectively creating a state of budget for the prosperity of the people as much as possible, the members of parliament personal for capacity factor, regulatory framework discussion of the state of budgeting, agency expertise, political party system and the party system, the proposal state budgeting of government, participation of the people`s, and the Constitutional Court.
