Pada hakikatnya negara menjamin perlindungan, pribadi, keluarga dan masyarakat yang diwujudkan dengan pembangunan serta pembaharuan hukum yang konsisten serta responsif pada kondisi maupun kebutuhan masyarakat. Dalam pembaharuan hukum termasuk hukum pidana harus mempertimbangakan nilai-nilai yang hidup dalam masyarakat. Tindak Pidana Kekerasan dalam Rumah Tangga memiliki karakteristik tersendiri, terletak pada subyek yang spesifiknya yaitu pelaku sekaligus korbannya berada dalam satu lingkup rumah tangga. Pada umumnya penyelesaian suatu perkara pidana menggunakan mekanisme peradilan formal (Sistem Peradilan Pidana). Dalam perkembangan hukum pidana dikenal Keadilan Restoratif yaitu keadilan yang berorientasi pada pemulihan kekeadaan semula (restorasi). Tesis ini membahas tentang penerapan restorative justice sebagai upaya penyelesaian tindakan kekerasan dalam rumah tangga. Tujuan dari penulisan ini adalah untuk mengetahui proses penanganan tindak kekerasan dalam rumah tangga di Polres Metro Jakarta Pusat, bagaimana mekanisme penerapan restorative justice dalam menanganai perkara KDRT, serta mengetahui kendala penegak hukum khusunya penyidik dalam menyelesaiakan perkara KDRT terkait dengan penerapan restorative justice tersebut. Penelitian ini menggunakan metode deskriptif kualitatif. Lokasi penelitian yang dipilih adalah Polres Metro Jakarta Pusat, dimana warga kota Jakarta berada dalam berbagai suku dan budaya serta etnis yang beragam. Hasil penelitian ini bahwa penerapan mediasi penal sebagai implementasi dari nilai-nilai restorative justice dalam kasus tindak kekerasan dalam rumah tangga yang terjadi di wilayah Polres Metro Jakarta Pusat oleh penyidik dilakukan mesikipun terdapat kendala hukum dalam penerapannya, hal ini dilakukan karena penyidik yang lebih mengedepankan keutuhan rumah tangga tersebut serta lebih memperhatikan faktor-faktor sosial dan psikologis anak dalam rumah tangga tersebut. Hingga penelitian ini selesai, pihak Polres Metro Jakarta Pusat follow up atau tindak lanjut perlindungan hukum terhadap korban sebagai upaya pencegahan dengan cara mewajibkan kepada pelaku kekerasan untuk wajib lapor. Selanjutnya dengan adanya delik aduan pada UU PKDRT menjadi dasar bagi penyidik Unit PPA Polres Metro Jakarta Pusat untuk membuat kebijakan untuk menyelesaikan perkara kekerasan dalam rumah tangga dengan mediasi yang mendamaikan antara pihak korban dan pelaku serta keluarga dalam mencari solusi yang terbaik (win-win solution).

In principal, the country guarantees the protection of individual, family and community through the development of consistent and responsive law reform towards the conditions and needs of the community. In the law reform including criminal law, the values that exist in the community must be considered. Domestic Violence has its own characteristics in which the perpetrators and victims are within the same domestic sphere. Generally, the resolution of a criminal case employs the formal justice mechanisms (Criminal Justice System). In the development of criminal law, Restorative Justice which is restorationoriented justice is employed to restore a case into its normal state (restoration).

This thesis discusses the implementation of restorative justice as an attempt in adjudicating domestic violence. The purpose of this study is to investigate the handling of domestic violence in Central Jakarta Metro Police Resort, the mechanism of the implementation of restorative justice in domestic violence cases, and to find out the constraints that the investigating officers have in solving the cases of domestic violence associated with the implementation of restorative justice. This research uses descriptive qualitative method. The study was conducted at the Central Jakarta Metro Police Resort which in charge for residents coming from various cultures and ethnics living in the area.

The results of this study revealed that the application of penal mediation as an implementation of the values of restorative justice in the cases of domestic violence that occurred in the area of Central Jakarta Metro Police Resort conducted by the investigating officers is employed because the unity of the household is primarily put into attention by considering the social and psychological factors of children. Until the completion of this study, the Central Jakarta Metro Police Resort keeps on following up legal protection for victims as prevention by requiring the crime abuser to do compulsory report to the police office. Furthermore, with the abuse compliance on the Domestic Violence Law (UU PKDRT) as the base for the PPA Unit investigating officers at the Central Jakarta Metro Police Resort to make a policy to resolve domestic violence cases through mediation between parties both victims and perpetrators as well as families in finding the best solution (win-win solution).
