Metode penelitian yang digunakan dalam penulisan tesis ini adalah metode penelitian hukum normatif dan yang bertujuan untuk mendapatkan data guna mendukung penulisan tesis ini. Hasil penelitian menunjukkan bahwa hubungan hukum yang terjadi antara pihak nasabah atau penyewa Safe Deposit Box dengan pihak bank sebagai pemilik dan pengelola Safe Deposit Box adalah hubungan hukum yang timbal balik, yaitu menimbulkan hak dan kewajiban di antara kedua belah pihak yang saling terikat dalam perjanjian sewa menyewa. Tanggung jawab bank yang paling utama, selaku pemilik dan pengelola Safe Deposit Box adalah menjamin keamanan barang simpanan penyewa atau nasabah, Namun sebaliknya bank tidak bertanggung jawab terhadap kerugian apabila barang simpanan itu hilang atau rusak akibat keadaan memaksa atau overmacht, alasan utama bank tidak bertanggung jawab adalah karena pihak bank sudah menerapkan klausula baku yang intinya membebaskan bank seluruhnya dari tanggung jawab dan kewajiban terhadap jasa pengamanan yang diberikan kepada penyewa.
