ABSTRAK
Iklim yang terus berubah cendrung menciptakan keadaan cuaca yang tidak bisa di perkirakan manusia. Salah satu akibat buruknya adalah banjir. Tapi bisa dicegah dengan persiapan yang matang. Jakarta sebagai Ibu Kota Negara sebagai pusat pemerintahan, ekonomi dan pendidikan dalam menjalankan tidak boleh terganggu dengan hal tersebut. Jakarta Selatan sebagai daerah resapan air di Daerah Khusus Ibukota Jakarta mempunyai peranan penting dalam mencegah banjir. Untuk mencegah hal tersebut perlu dibangun sebuah Waduk di daerah Lebak Bulus. Maka diadakan pengadaan tanah guna pembanguna demi kepentingan umum. Pengadaan tanah guna kepentingan umum diatur dalam Peraturan Presiden Nomor 36 Tahun 2005 juncto Nomor 65 Tahun 2006.Pelaksanaan pengadaan tanah merupakan persoalan yang kompleks karena terdapat berbagai tahapan dan proses yang harus dilalui serta adanya kepentingan pihak-pihak yang saling bertentangan. Hal inilah yang akan dikupas dalam bentuk sebuah penulisan tesis yang berjudul Pengadaan Tanah Bagi Pembangunan Waduk Lebak Bulus Di Jakarta Selatan dengan tujuan untuk mengetahui proses, pelaksanaan pengadaan tanah guna proyek pembangunan Waduk Lebak Bulus di Jakarta Selatan dan kendala yang di hadapi dilapangan. Metode pendekatan yang dipergunakan dalam penelitian ini adalah metode yuridis empiris dan tipe penelitian Deskriptis Analitis yaitu prosedur atau pemecahan masalah penelitian dilakukan berdasarkan fakta-fakta aktual dalam pengadaan tanah ini. Hasil penelitian menunjukan bahwa penetapan harga ganti rugi dalam pembangunan Waduk Lebak Bulus tidak sesuai dengan keinginan masyarakat. Masyarakat menginkan ganti rugi yang sesuai harga pasar tetapi tidak melihat bahwa lokasi tanah dan kondisi fisik bangunan mempengaruhi saat penilaian ganti rugi juga adanya unsur sosial atas tanah. Pemerintah yang lamban memberikan ganti rugi juga menciptakan ketidak adilan bagi masyarakat karena mereka sudah kehilangan tanah mereka tapi belum juga dibayarkan hak mereka.

ABSTRACT
The climate which always changed had been established the unpredictable weather. One of the worst impact is flood. But it could be overcome if human did a good preparedness regarding to this problem. Jakarta as the capital city, and also as the center of governance, economy and education is not allowed to get those threats. South Jakarta as the water infiltration area in Jakarta holds an importanta role in overcoming the flood. To overcome this problem, its very important to establish a reservoir in Lebak Bulus. Because of this reason, the land provision for development regarding to public needs is established. The land provision for public needs is regulated in President’s Decree No. 36/2005 jo No. 65/2006.The implementation of land provision is a complex problem because there are lots of steps and processes that need to be done, thus many stakeholders have different interests in this issue. This problem will be solved in this thesis with title “The Land Provision for Development Lebak Bulus Reservoir Construction in South Jakarta and it aims to know the process, the obstacles that existed, and also the solution of land provision for Lebak Bulus reservoir construction in South Jakarta). The method that has been used in this research is juridical-empiric and the type of this research is analytical-descriptive; its a procedure or problem resolution that has been conducted based on the actual facts in land provision case. The result of this research shows the compensation rate in Lebak Bulus reservoir construction which is not appropriate with community’s needs. The community wants a compensation that suitable with market rate, but they do not concern with the location of land and the physical condition of the construction that would affected the compensation, and the social factor of the land. The government also has a slow action to give compensation, it creates the unfair sphere among community because community lost their land, but they still could not get their rights.
