Dalam pasar modal Indonesia saat ini dikenal dengan Dana Investasi Real Estat berbentuk Kontrak Investasi Kolektif sebagai salah satu produk investasi pasar modal. Permasalahan yang dibahas dalam penulisan ini adalah mekanisme penerbitan Dana Investasi Real Estat menurut peraturan perundang-undangan Indonesia, permasalahan perpajakan terhadap Dana Investasi Real Estat berbentuk Kontrak Investasi Kolektif, dan peran, tugas dan tanggung jawab Notaris dalam rangka Proses Penerapan Dana Investasi Real Estat berbentuk Kontrak Investasi Kolektif. Tujuan penelitian ini adalah untuk menjawab permasalahan yang akan dibahas dalam tesis ini. Metode penelitian yang digunakan untuk menjawab permasalahan tersebut adalah penelitian yuridis normatif dengan metode kepustakaan. Penerbitan Dana Investasi Real Estat berbentuk Kontrak Investasi Kolektif di Indonesia sebagai usaha menciptakan produk investasi baru yang selaras dengan perkembangan pasar modal internasional, kondisi pasar modal nasional serta kebutuhan investor. Dana Investasi Real Estat berbentuk Kontrak Investasi Kolektif sebagai alternatif investasi yang kompetitif dan bermanfaat sebagai salah satu pendorong pertumbuhan industri properti di Indonesia. Namun dalam pelaksanaannya masih terdapat berbagai hambatan diantaranya hambatan mengenai perpajakan. In the Indonesia Capital Market, Collective Investment Contract Real Estate Investment is currently known as one of capital market investment products. The problems discussed in this topic is the initial public offering mechanism of Real Estate Investment according to the Indonesia regulation, tax issues in Real Estate Investment, and the role, duties and responsibilities of a notary in order to Process the application of the Real Estate Investment. The purpose of this research is to answer the problems that will be discussed in this thesis. The research methods that was adapted for this thesis is the juridical normative approach with literature study characteristic. The issuance of Collective Investment Contract Real Estate Investment in Indonesia as an effort to create new investment products that are in harmony with the development of international capital markets, the national capital market conditions as well as the needs of investors. Collective Investment Contract Real Estate Investment as an alternative to a competitive and rewarding investment as one of the drivers of growth in the property industry in Indonesia. However, in practice there are still numerous obstacles including barriers regarding taxation. In the implementation of Collective Investment Contract Real Estate Investment required Notary's role as a capital market supporting professionals who were involved in the making of the deed of establishment of the Special Purpose Company (SPC), established for the benefit of Collective Investment Contract Real Estate Investment, deed relating to the implementation of the general meeting of the holders of Collective Investment Contract Real Estate Investment and deed of the liquidation or dissolution of the Collective Investment Contract Real Estate Investment.
