ABSTRAK
Tesis ini membahas mengenai pembuatan akta Notaris yang ditandatangani tidak di hadapan Notaris Permasalahan dalam kasus tersebut timbul karena Notaris memberikan akta yang belum ditandatanganinya kepada penghadap untuk ditandatangani oleh penghadap lainnya tanpa di hadapan Notaris Kemudian timbul permasalahan mengenai keabsahan akta tersebut Hasil dari penelitian ini adalah bahwa akta tersebut menjadi tidak sah dan kehilangan otentisitasnya karena aktanya batal demi hukum Akibat hukum dari akta yang batal demi hukum tersebut adalah tindakan hukum yang disebut dalam akta tersebut dianggap tidak pernah terjadi Penelitian ini menggunakan metode penelitian hukum normatif dengan analisis terhadap Undang Undang Jabatan Notaris dan Kode Etik Notaris dengan tipe penelitian evaluatif Kata kunci Pembuatan Akta Yang Ditandatangani Tidak Di Hadapan Notaris

ABSTRACT
This Thesis discusses about making of notary rsquo s deed which not be signed in front of notary The problem of this case occurs because notary giving deed that have no signed to the appearer to be signed by the other appearer without presence of notary Then raised the question as to the authenticity of the deed The result of this thesis namely the mentioned notary rsquo s deed is not lawfully and loss its authenticity because the deed was void by law The legal consequence from the deed which void by law is all of legal actions which have been stipulated on the mentioned deed are deemed never happens This study uses normative legal research method with the analysis of the Law of Notary Position and Code of Ethics and is an evaluative research Keywords Deed was not signed in front of Notary
