ABSTRAKTesis ini membahas mengenai salah satu permasalahan dalam pelaksanaan program landreform di Indonesia yaitu pelaksanaan ketentuan tentang larangan tanah absentee yang dalam pelaksanaannya menimbulkan beberapa sengketa antara bekas pemilik tanah dengan yang menguasai tanah saat ini. Metode penelitian dilakukan dengan cara penelitian kepustakaan yang bersifat yuridis normatif dan bersifat preskriptif analisis yaitu suatu penelitian yang tujuannya memberikan jalan keluar atau saran untuk mengatasi masalah mengenai sebab terjadinya sengketa kepemilikan agar dapat memberikan analisis yang mendalam terhadap permasalahan yang dipaparkan.Permasalahan dalam tesis ini diawali dengan diterbitkannya penetapan pemerintah (SK. KINAG) terhadap sebidang tanah sebagai obyek yang terkena ketentuan absentee, namun bekas pemilik tanah keberatan dan tidak mau menerima ganti rugi dengan alasan tidak pernah menerima pemberitahuan terhadap penetapan tersebut sehingga mengajukan gugatan kepada Pengadilan. Para penggarap sebagai penerima hak juga mengabaikan ketentuan tentang kewajiban dan larangan sebagaimana yang ditetapkan dalam surat keputusan pemberian hak milik dengan mengalihkan tanah tersebut kepada pihak lain.Kesimpulan dari tesis ini adalah bahwa sengketa timbul diakibatkan oleh kurang tertibnya pelaksanaan landreform oleh pelaksana, baik secara sosialisasi, administrasi dan sasaran penerima redistribusi obyek landreforam, sehingga tujuan dari program landreform tidak terpenuhi. Terhadap kondisi tersebut Pemerintah telah melakukan upaya penertiban, dan terhadap Keputusan Pengadilan yang telah berkekuatan hukum tetap harus ditindaklanjuti dengan mempedomani ketentuan yang berlaku.

ABSTRACT

This thesis discusses about problems in the implementation of the Landreform?s program in Indonesia, wich is provisions on the prohibition of Absentee?s land that raises several disputes, between the former land owner rescent had owner. Method of this research is conducted by the normative literature research and prescriptive analyze, which goal is providing a solution or suggestion to solve such problem, the issue of ownership of the cause of dispute, in order to be given a more detail analysis.

The Problems in this thesis begins with the Issuance Decree of Inspector of Agrarian Affairs (SK. KINAG) on a land as an object affected by the provisions of absentee, but in this case landowner objected and then refused to accept the notice of the determination, and field a lawsuit to the State Court. The tenants tillers as assignee, prejudice to provisions concerning liability and prohibitions as specified in the Decree of granting land title by transferring the land to other party.

The conclusion is that a dispute caused by non effectiveness of the implementation of landreform, either socialization, administration and redistribution target object of landreform beneficiaries, and at the end the purpose of landreform has not been conducted properly. Toward this conditions, the government had been conducted an arrangement of compliance the preventy regulating and toward to the final and binding?s verdict decision shall be underteken based on the relating provisions.
