Barrier to entry merupakan suatu hal yang tidak melanggar hukum karena terbentuk secara alamiah dan juga umumnya diatur Pemerintah untuk membuat suasana yang kondusif dalam persaingan usaha serta mensejahterakan rakyat. Akan tetapi, terdapat bentuk-bentuk diskriminasi yang juga merupakan barrier to entry, dalam hal ini dapat juga sebagai suatu hal yang bertentangan dengan UU No. 5 Tahun 1999, khususnya pasal 19 terkait dengan konsep Rule of Reason. Tesis ini membahas permasalahan mengenai bentuk-bentuk barrier to entry yang bertentangan dengan pasal 19 Undang-Undang Nomor 5 Tahun 1999 terkait dengan konsep Rule of Reason. Tesis ini juga membahas mengenai barrier to entry terhadap suatu pasar ditinjau dari pasal 19 Undang-undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat terkait perkara jasa pelayanan taksi Bandara Hasanuddin Makassar dan taksi Bandara Juanda Surabaya. Penelitian Tesis ini menggunakan metode deskriptifanalisis. Hasil penelitian ini menyimpulkan bahwa terdapat bentuk-bentuk barrier to entry yang bertentangan dengan pasal 19 Undang-Undang Nomor 5 Tahun 1999 terkait dengan konsep Rule of Reason, yakni hambatan yang terkait dengan sunk cost (biaya tertanam) dan investasi awal yang besar, tindakan-tindakan yang diciptakan oleh perilaku perusahaan lama, keputusan/regulasi suatu perusahaan, pembatasan akses terhadap Konsumen dan regulasi oleh Pemerintah. Sebagian hambatan tersebut juga terdapat pada putusan KPPU terkait perkara jasa pelayanan taksi Bandara Hasanuddin Makassar dan taksi Bandara Juanda Surabaya.

Barrier to entry is a matter that does not violate the law because it occurs naturally and generally set by the Government to create a conducive atmosphere in the competition and the welfare of the people. However, there are other forms of discrimination that are also barrier to entry. In this case, it violates the Law No. 5 of 1999, specifically article 19 related to the concept of the Rule of Reason. This thesis discusses the issues concerning the forms of barrier to entry that violate article 19 of Law No. 5 of 1999 relating to the concept of the Rule of Reason . This thesis also discusses the barrier to entry to the market in terms of article 19 of Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition matters related to services taxi cab in Hasanuddin Airport Makassar and in Surabaya Juanda Airport. This thesis research uses descriptive - analytical method. The results of this study concluded that there are other forms of barrier to entry that violate article 19 of Law No. 5 of 1999 relating to the concept of the Rule of Reason, the barriers associated with sunk costs (embedded costs) and a large initial investment, action that created by the behavior of the incumbent company, the decision/regulation of an company enterprise, restrictions on access to consumers and regulation by the Government. Most of these barrier to entry are also present in the case related to the Commission's decision of taxi services Hasanuddin Airport Makassar and Surabaya Juanda Airport taxi.
