ABSTRAK
Tesis ini mengkaji ketidaksinkronan berbagai produk hukum yang mengatur distribusi urusan pemerintahan khususnya urusan pemerintahan kehutanan. Secara khusus produk hukum tersebut meliputi UU No. 32 Tahun 2004 jo PP No. 38 Tahun 2007, dan PP No. 6 Tahun 2007 jo PP No. 3 Tahun 2008.Penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis normatif. Kajian dilakukan dengan cara menganalisis pelaksanaan kewenangan pemerintah daerah mengelola sumber daya hutan yang diatur berdasarkan peraturan perundang-undangan sektor kehutanan dan peraturan perundang-undangan tentang pemerintahan daerah.Dilihat dari sudut politik, desentralisasi dimaksudkan untuk mencegah penumpukan kekuasaan pada satu pihak dan menarik rakyat ikut serta dalam pemerintahan. Dilihat dari sudut teknik organisasi pemerintahan, desentralisasi dimaksudkan untuk mencapai suatu pemerintahan yang efisien. Dari sudut kultural, desentralisasi dimaksudkan agar perhatian dapat sepenuhnya ditumpukan kepada kekhususan suatu daerah seperti geografis, keadaan penduduk, kegiatan ekonomi, dan watak kebudayaan. Dari sudut kepentingan pembangunan ekonomi, desentralisasi diperlukan karena pemerintah daerah secara langsung membantu pembangunan tersebut.Hasil penelitian menemukan materi hukum dari ketidaksinkronan berbagai produk hukum baik secara vertikal maupun horisontal dalam sektor kehutanan, yaitu pengaturan kewenangan pemerintah daerah dalam hal penetapan organisasi KPH, wilayah pengelolaan hutan, penerbitan IUPHHK, dan mengelola sumber daya hutan dalam peraturan perundang-undangan sektor kehutanan bertentangan dengan hak daerah otonom untuk mengelola dan menikmati hasil pengelolaan sumber daya hutan dalam peraturan perundang-undangan tentang pemerintahan daerah. Selain itu, hak daerah otonom untuk mengelola sumberdaya hutan kerapkali disalahartikan oleh pemerintah daerah sebagai kebebasan pemerintah daerah untuk menerbitkan IPHHK. Dalam penelitian ini juga ditemukan dampak ketidaksinkronan berbagai produk hukum tersebut yaitu semakin sempitnya kewenangan pemerintah daerah untuk menetapkan organisasi KPH, wilayah pengelolaan hutan, dan penyerahan kewenangan pengelolaan hutan oleh pemerintah kepada BUMN telah menggeser hak masyarakat setempat untuk mengelola dan menikmati hasil hutan. Di sisi lain ketidaksinkronan tersebut menimbulkan tindakan kesewenangan aparatur pemerintah daerah dalam mengelola sumber daya hutan. Hasil penelitian ini menyarankan agar dilakukan sinkronisasi produk-produk hukum yang mengatur distribusi urusan pemerintahan daerah untuk mengelola sumber daya hutan, peningkatan peran serta masyarakat dalam pengelolaan hutan, dan peningkatan kapasitas aparatur pemerintah daerah.

ABSTRACT
This thesis studies the unsynchronized laws on the government affairs distribution especially the forest management affairs. In particular, some of the laws that regulated this are Law Number 32 Year 2004 jo Government Regulation Number 38 Year 2007, and Government Regulation Number 6 Year 2007 jo Government Regulation Number 3 Year 2008.This research is a qualitative research with normative judicial approach. This research is done by analyzing the implementation of local government authority in managing the forest resources as stipulated by the forestry laws and the local government laws.From the political view, decentralization is intended to prevent the accumulation of power in one hand and to draw people participation in government affairs. From the technical government organization view, decentralization is intended to acquire an effective government. From the cultural view, decentralization is intended to draw people attention to specialties of a region based on geographic, society condition, economic activity, and cultural character. From the economic development view, decentralization is necessary because the local governments can be directly involved in their economic development.This research found the unsynchronized laws either vertically or horizontally on forestry regulation, including the local government authority in the establishment of the KPH organization, the management of forest area, the issue of the IUPHHK, and the management of forest resources as stipulated by forestry laws is not in line with the local government right to manage and get benefit from forest resources as stipulated by local government laws. Furthermore, the right to manage the forest resources is often misunderstood by the local government as freedom in issuing the IPHHK. This research also found that the effects of this unsynchronized laws are the local government right to stipulate the KPH organization and the forest area management become limited, and the delegation of forest management from the central government to the BUMN have deny the local society rights to manage and get benefit from the forest resources. On the other hand, this unsynchronized laws have induced the local government official abuse of power in managing the forest resources. This research findings suggest that the local government laws and forestry laws that regulate the local government authority in the forest resources management should be synchronized, the society participation in forest management should be improved, and the local government official capacity building should be enhanced.
