Seiring dengan semakin berkembangnya perekonomian dan industri di Kota Batam, kebutuhan akan perumahan dan pemukiman pun semakin meningkat. Dengan ketersediaan lahan yang semakin terbatas, para developer mulai melakukan pembangunan atas rumah-rumah susun yang lebih efisien dalam penggunaan ruang dan tanah. Tetapi dalam praktek jual beli rumah susun tersebut, terdapat kecenderungan terjadinya pelanggaran hukum. Dalam kasus Rumah Susun Windsor Phase Batam adalah bahwa unit Rumah Susun telah diperjualbelikan sebelum pembangunan Rumah Susun tersebut selesai dan dapat diperjualbelikan berdasarkan Undang-Undang Rumah Susun. Tesis ini membahas tentang bagaimana dengan penjualan rumah susun yang dilakukan atas dasar tanah bersama yang belum bersertipikat, pelanggaran hukum apa saja yang terjadi, serta solusi bagi para pemilik unit rumah susun dalam kaitannya dengan kasus jual beli rumah susun Windsor Phase Batam. Metode penelitian yang digunakan adalah metode analisis kualitatif dengan pendekatan yuridis-empiris dengan hasil berupa laporan penelitian bersifat preskriptif. Dengan tujuan memperoleh kesimpulan mengenai pelanggaran hukum apa saja yang terjadi dalam kasus jual beli rumah susunWindsor dan apa langkah-langkah yang dapat ditempuh oleh para pemilik unit rumah susun Windsor untuk memperoleh jaminan kepastian hukum dalam kepemilikan atas objek yang bersangkutan.

The development of Batam in the economy and industrial sector, escalated the housing and habitation needs. With the availability of lands are likely more limited now, the developers began to establish the construction of condominium which are more efficient in the use of space and land. But in the practice of buying and selling the condominium units, there is a tendency of violating the law. The case of Windsor Phase Batam Condominium is the units have been sold prior to the construction of the condominium completed and can be marketed under the Undang-Undang Rumah Susun or the Condominium Law. This thesis is discussing about what if the flats are being sold prior to having a certificate of condominium unit, what are the violations that happened during the sales of the condominium units, as well as the solutions for the owner of the condominium units in the relation of the case of the sales of Windsor Phase Condominiums. The research method is qualitative analysis with juridical-empirical approach to reach a prescriptive report, with the purpose of obtaining the legal conclusions regarding any violations that occur in the case of the sales of Windsor Phase Condominiums and the actions that can be taken by the owners of the units of Windsor Phase Condominium to obtain a legal certainty in the ownership of the related object.
