Skripsi ini membahas mengenai pengaturan, mekanisme, dan pelaksanaan pengangkatan Jabatan Hakim Agung setelah berlakunya UU Nomor 3 Tahun 2009 Juncto UU Nomor 5 Tahun 2004 Juncto UU Nomor 14 Tahun 1985 Tentang Mahkamah Agung dan Implikasi mengenai Putusan Mahkamah Konstitusi Nomor 27/PUU-XI/2013 tentang perkara Pengujian Undang-Undang Nomor 3 Tahun 2009 tentang Perubahan Kedua Atas Undang-Undang Nomor 14 Tahun 1985 tentang Mahkamah Agung dan Undang-Undang Nomor 18 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 22 Tahun 2004 tentang Komisi Yudisial terhadap UUD NRI T 1945. Pengangkatan Jabatan Hakim Agung merupakan unsur penting dalam Hukum Tata Negara, diperlukan pengaturan, mekanisme yang jelas, dan harus terus menerus terjamin pelaksanaannya. Pada Tahun 2013, tiga orang calon hakim agung memohon kepada Mahkamah Konstitusi untuk menyatakan Pasal 8 ayat (2), (3), dan (4) UU Mahkamah Agung dan Pasal 18 ayat (4) UU Komisi Yudisial bertentangan dengan Pasal 24A ayat (3) UUD NRI T 1945, karena kewenangan DPR seharusnya tidak "memilih" akan tetapi "menyetujui" calon hakim agung. Tahun 2014, Mahkamah Konstitusi mengabulkan permohonan para pemohon untuk seluruhnya. Penelitian ini dikaji dengan menggunakan metode penelitian hukum normatif. Bahan hukum primer yang berupa Putusan Mahkamah Konstitusi dianalisis dengan menggunakan penafsiran. Hasil penelitian menunjukan dalam pengangkatan Jabatan Hakim Agung setelah berlakunya UU Nomor 3 Tahun 2009 Juncto UU Nomor 5 Tahun 2004 Juncto UU Nomor 14 Tahun 1985 Tentang Mahkamah Agung, dalam Pengaturan dan Mekanisme terdapat kekurangan yaitu terjadinya ketidak konsistenan antara Konstitusi dengan Peraturan Perundang-Undangan, serta dalam pelaksanaan pengangkatan sering terjadi permasalahan yaitu tidak terpenuhinya pengusulan calon hakim agung oleh Komisi Yudisial ke DPR. Implikasi Putusan Mahkamah Konsitusi tersebut terhadap pengangkatan Jabatan Hakim Agung adalah adanya perubahan mekanisme pengangkatan hakim agung, yaitu dilakukan pembatasan kewenangan DPR yaitu hanya berhak "menyetujui" calon hakim agung yang diusulkan oleh Komisi Yudisial.

This thesis discusses the regulation, mechanism, and implementation the appointment of Supreme Court Judge Position after Law No. 3 of 2009 Juncto Law No. 5 of 2004 Juncto Law No.14 of 1985 concerning The Supreme Court and the Implication of the Constitutional Court Decision No. 27/PUU-XI/2013 about case Consitutional Review of Law No. 3 of 2009 about on the Second Amendment Law No. 14 of 1985 concerning The Supreme Court and the Law No. 18 of 2011 concerning Amendment to Law No. 22 of 2004 concerning The Judicial Commission to UUD NRI T 1945. The Appointment Supreme Court Judge Position is an important element in Constitutional Law, is needed regulation, clear mechanism, and should be guaranteed continuous in implementation. In The Year 2013, the three Candidates for Supreme Court Judge appealed to the Constitutional Court to declare Article 8 paragraph (2), (3), and (4) the Supreme Court Act and Article 18 paragraph (4) of the Judicial Commission contrary to Article 24A paragraph (3) UUD NRI T 1945, because of the authority of the Parliament should not "choose" but "approve" Candidates for Supreme Court Judge. In 2014, the Constitutional Court granted the petition of the applicant in its entirety. This study examines the use of normative legal research methods. Primary legals materials that Constitutional Court Decision are analyzed by using interpretation. The results showed in the appointment of Supreme Court Judge Position after Law No. 3 of 2009 Juncto Law No. 5 of 2004 Juncto Law No.14 of 1985 concerning The Supreme Court, in the regulation and the mechanism there is the deficiency that happened inconsistency between the Constitution with Regulations State Institusions, and the implementation of appoinment there are problems of the non-fulfillment of the nomination of Supreme Court Judge by the Judicial Commission to the Parliament. Implications of the Decision of the Constitutional Court against the appointment of Supreme Court Judge Position is a change in the mechanism of appointment of Supreme Court Judge, limiting the authority of Parliament is only entitled "approve" candidate for Supreme Court Judge proposed by the Judicial Commission.
