ABSTRAK
Kreditur Separatis adalah kreditur Pemegang hak jaminan kebendaan yang dapat bertindak sendiri dan didahulukan pembayaran haknya atas boedel pailit dibandingkan kreditur lainnya. Namun dalam kasus ini bahwa kreditur separatis tidak diberikan hak-haknya atas boedel pailit, seperti kasus PT. Perusahaan Pengelola Aset selaku Pemohon I dan PT. Bima Prima Persada selaku Pemohon II terhadap Tim Kurator PT. Texmaco Jaya selaku Termohon. Adapun Pemohon selaku Kreditor Separatis yang memegang jaminan kebendaan tidak didahulukan dan tidak mendapat penjualan pembayarannya atas pembagian boedel pailit. Disebabkan pengajuan tenggang waktu telah melampui batas berdasarkan Pasal 192 Undang-Undang Kepailitan dan mengenai daftar pembagian yang disusun oleh termohon untuk para Kreditor Preferen sudah sesuai dengan bagian masing-masing dan hukum yang berlaku. Penelitian ini menggunakan metode pendekatan yuridis normatif yang dilakukan dengan penelitian hukum kepustakaan terhadap peraturan perundang undangan yang berlaku serta dituangkan dalam bentuk tulisan preskriptif analitis yang memberikan jalan keluar berdasarkan teori hukum yang berkaitan dari suatu permasalahan yang terjadi. Dengan demikian kreditor separatis tidak diberikan haknya atas pembagian boedel pailit berdasarkan Pasal 192 dan Pasal 196 Ayat (4) Undang ? Undang kepailitan

ABSTRACT
Separation Creditors are creditors holding the property guarantee right who can act by themselves and whose payment right on the bankrupt estate has to be prioritized compared with other creditors. However, in this case, the separation creditors are not given their rights on the bankrupt estate, such as in the case of PT. Perusahaan Pengelola Aset as the Petitioner I and PT. Bima Prima Persada as the Petitioner II towards the Trustee Team of PT. Texmaco Jaya as the Petitionee. Nevertheless, the Petitioners as the Separation Creditors who hold the property guarantee are not prioritized and cannot obtain their payment sales on the bankrupt estate division.This is caused by submitting a grace period which has exceeded the limit based on Clause 192 ofthe Bankruptcy Law, and about the division list made by the petitionee for the Preferential Creditors, it is already suitable with each part and the prevailing law.This research uses the normative judicial approach method conducted by legal literature research towards the prevailing laws and regulations, and written in a form of analytical prescriptive writing which provides a solution based on the relevant legal theory towards the occuring issues.
