ABSTRAKTesis ini membahas mengenai perspektif Hukum Islam terhadap perlindungan hakcipta di Indonesia. Penelitian ini bertujuan untuk menjawab isu hukum apakahperlindungan hak cipta di Indonesia bertentangan dengan Hukum Islam atau tidak.Penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatankonseptual dan pendekatan komparatif. Hasil dari penelitian ditemukan jawabanbahwa perlindungan hak cipta di Indonesia tidak bertentangan dengan HukumIslam. Kesimpulannya, sumber utama Hukum Islam yaitu Al Quran dan Hadistidak memberikan penjelasan eksplisit mengenai perlindungan hak cipta.Landasan perlindungan hak cipta diberikan di dalam sumber Hukum Islamlainnya yaitu ijma, qiyas, dan maslahah mursalah. Berdasarkan ketiga sumberHukum Islam tersebut, hak cipta dikategorikan sebagai harta dalam bentukmanfaat. Selain itu, praktek negara-negara yang menganut Hukum Islam yaituArab Saudi, Yordania, dan Mesir juga menunjukkan bahwa perlindungan hakcipta tidak bertentangan dengan Hukum Islam.

ABSTRACTThis thesis discusses the perspective of Islamic Law on copyright protection inIndonesia. It also aims to address the issue whether the law of copyrightprotection in Indonesia is compatible to Islamic Law or not. This study employsnormative and juridical method by using conceptual and comparative approach.The results of the study will be the answer whether copyright protection inIndonesia is compatible to Islamic Law or not. The research found that the mainsources of Islamic law, namely the Holy Qur'an and the Hadits do not provideexplicit provisions and explanations about copyright protection. The generalprinciples of copyright protection in Islamic Laws can be found at ijma, qiyas, andmaslahih mursalah. Based on those resources copyright is categorized as propertyin the form of manfa?ah. In addition, the practices conducted by Muslimcountries, namely Saudi Arabia, Jordan, and Egypt also suggest that copyrightprotection, to some extent, is compatible with Islamic law.
