Undang-Undang Jabatan Notaris memberikan kewenangan atribusi kepada Menteri untuk melakukan pengawasan terhadap notaris dan pengawasan tersebut dilakukan dalam bentuk pendelegasian yang diberikan oleh Undang-Undang Jabatan Notaris kepada Menteri untuk mengangkat Majelis Pengawas Notaris. Fungsi-fungsi pengawasan terhadap notaris dilakukan oleh Majelis Pengawas Notaris sebagai lembaga yang independen bukan oleh Menteri. Majelis Pengawas Notaris diangkat oleh Menteri yang secara berjenjang terdiri dari Majelis Pengawas Daerah di Kota atau Kabupaten, Majelis Pengawas Wilayah di Propinsi dan Majelis Pengawas Pusat di Ibu Kota Negara,yang masing-masing terdiri dari 9 (sembilan) orang yaitu 3 (tiga) orang mewakili unusr Organsasi Profsei Notaris, 3 (tiga) orang mewakili unsur Pemerintah dan 3 (tiga) orang mewakili unsur akademisi. Notaris selaku Pejabat Umum diangkat oleh Menteri tapi Menteri tidak dapat memberhentikan Notaris kecuali dengan usulan dari Majelis Pengawas Notaris. Majelis Pengawas Notaris diberi kewenangan untuk menyelenggarakan sidang pemeriksaan dan penjatuhan sanksi terhadap Notaris yang terbukti melakukan pelanggaran Undang-Undang Jabatan Notaris dan atau Kode Etik Notaris. Undang Undang Jabatan Notaris tidak memberikan otonomi kepada Majelis Pengawas Notaris untuk penjatuhan sanksi pemberhentian atau pemberhentian dengan tidak hormat terhadap notaris dari jabatannya tapi sifat sanksinya hanya pengusulan kepada Menteri berupa pemberhentian dan atau pemberhentian dengan tidak hormat terhadap notaris dari jabatannya. Dalam hal ini Menteri secara tidak langsung melakukan pengawasan terhadap notaris, yang akan mempengaruhi independensi Majelis Pengawas Notaris mauprm Notaris selaku Pejabat Umum.

Notary Act authorizes attribution to the Minister to oversee the supervision of a notary public and be in the form of delegation given by the Notary Act to the Minister to appoint a Notary Supervisory Council. The functions performed by the supervision of a notary public Notary Supervisory Council as an independent institution not by the Minister.

Notary Supervisory Council appointed by the Minister in stages consisting of a Supervisory Council in the City or Regional District, Regional Supervisor at Provincial Assembly and Assembly Center Supervisor at the State Capital, each of which consists of 9 (nine) is 3 (three) unusr represent the organization with Profsei Notary, 3 (three) persons representing the elements of the government and 3 (three) persons representing academicians. Acting as a Notary Public appointed by the Minister, but the Minister can not dismiss Notary except with the proposal of the Supervisory Council of the Notary.

Notary Supervisory Council is authorized to hold hearings and sanctions against the Notary who proved to have violated the Act and the Notary or Notary Code. Notary Act does not give autonomy to the Supervisory Council sanctions Notary for dismissal or dismissal with respect to the notary from office but the nature of the sanction is only a proposal to the Minister and the dismissal or dismissal with respect to the notary from office. In this case the Minister is not directly supervise the notary, which would affect the independence of the Supervisory Council as a Notary and Notary Public Offrcials.
