[Penelitian ini bertujuan untuk mengetahui apa yang menjadi dasar pertimbangan hakim dalam menentukan hak dan bagian waris anak luar kawin yang diakui (studi kasus putusan nomor 752 PK/PDT/2011). Penelitian ini merupakan penelitian hukum yang sifatnya yuridis normatif menggunakan data sekunder yangdapat berupa Peraturan Perundangan dan buku-buku. Kesimpulan yang diperoleh dari hasil penelian ini dapat menjawab permasalahan, anak luar kawin hanya memilikihubungan dengan ibu dan keluarga ibunya dalam hal keperdataan. Tapi dengan adanya pengakuan dari ayah anak luar kawin, anak tersebut mempunyai hubungan dengan ayah biologisny. Dalam kasus ini perkawinan yang dilakukan serta kedudukan suami dan anak-anak yang dilahirkan dari perkawinan mereka tersebut dan sebagai ahli waris dari pewaris.
