Penyediaan tenaga listrik bersumber dari panas bumi belum sesuai dengan prinsip persaingan usaha yang sehat. Hal ini dapat dilihat dari tidak didapatkannya harga listrik yang wajar yang dapat mendorong pelaku usaha untuk berinvestasi. Teknologi adalah bagian mendasar untuk membawa listrik dari energi panas bumi kepada seluruh masyarakat Indonesia. Komponen Teknologi membentuk nilai investasi yang nilainya dari tahun ke tahun semakin mahal sehingga di perlukan harga uap dan/atau listrik yang wajar untuk mendapatkan keuntungan. Harga yang wajar ini tidak didapatkan karena para investor baik BUMN maupun swasta tidak mungkin menjual listrik secara langsung kepada masyarakat umum karena PLN memiliki prioritas utama (First right of refusal). Jika harga patokan tertinggi terlalu rendah dan pengembang panas bumi memulai penawaran atas harga itu kepada PLN, maka akan berakhir di suatu titik dimana proyek-proyek tidak dapat atau layak untuk dikembangkan karna hasil negosiasi menghasilkan kesepakatan harga yang sangat tidak ekonomis. Hal ini menyebabkan terhambat masuknya pelaku usaha lain atau pesaing potensial untuk masuk ke dalam pasar (barrier to entry) sehingga meciptakan persaingan usaha yang tidak sehat. Penelitian ini adalah penelitian normatif dengan metode deskriptif analitis. Hasil penelitian menyarankan bahwa pemerintah seharusnya menentukan tarif harga jual listrik perwilayah dan perdaerah yang sudah ditetapkan yang bersifat ekonomis, sehingga tidak perlu ada proses negosiasi panjang antara pengembang PT PLN (Persero), karna perlunya faktor kepastian harga listrik untuk menghitung nilai keekonomian di dalam investasi di bidang usaha penyediaan tenaga listrik.

Provision of electric power from geothermal sources is not fulfill the principles of fair competition. It can be seen from the unreasonable electricity prices that cannot encourage businesses to invest. Technology is a fundamental part to bring electricity from geothermal energy to all the people of Indonesia. The Technology component to form the value of investments is getting more expensive so it needs a reasonable price of steam and / or electricity to make profit. The reasonable price is not obtained because both SOEs and private investors may not sell electricity directly to the general public because PLN has a top priority (First right of refusal). If the benchmark price is too low and geothermal developers start bidding up the price to PLN, it will end up at a point where projects may or may not be feasible to develop because the outcome of negotiations resulted in an agreement which the economical price will not be achieved. This leads to inhibited the entry of other business operators or potential competitors to enter the market (barrier to entry) and leads to unfair business competition. This thesis is using a normative study with descriptive analytical method. The results of the study suggest that the government should determine the reasonable selling price of electricity, so there should be no long negotiation process between the developer with PT PLN (Persero), because it is very important to know the exact price for certain in the needs for calculating electricity prices in the economic value of investment in electricity supply business.
