 Abstract

ABSTRAK
Perusahaan wajib menjaga kerahasiaan informasi perusahaannya dengan melakukan langkah-langkah tertentu. Langkah-langkah tersebut sepanjang tidak melanggar hak dasar pekerja tentu diperbolehkan. Contohnya adalah dengan membuat perjanjian kerahasiaan informasi secara tertulis guna mengikat calon pekerjanya agar tidak membocorkan rahasia perusahaan. Akan tetapi yang menjadi permasalahan, apabila perusahaan membuat perjanjian larangan bekerja di perusahaan lain yang sejenis atau larangan melakukan sesuatu hal yang akan menyaingi usaha bekas perusahaannya dalam jangka waktu. Perjanjian larangan tersebut biasa disebut dengan perjanjian kerja persaingan. Masyarakat umum tidak banyak menyadari bahwa sebetulnya perjanjian kerja persaingan melanggar hak dasar seseorang untuk memilih tempat bekerja. Padahal hak kebebasan untuk memilih tempat bekerja tersebut telah dijamin oleh Undang Undang Dasar Negara Republik Indonesia 1945, Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia, dan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Pada penulisan ini, penulis mengambil contoh kasus perjanjian kerahasiaan PT. Biggy Cemerlang yang sebetulnya salah satu klausul perjanjian kerahasiaan tersebut isinya adalah perjanjian kerja persaingan. Seharusnya hakim lebih cermat dalam memutus perkara yang terjadi pada mantan pekerja PT. Biggy Cemerlang, Hartoko, bahwa klausul perjanjian kerja persaingan adalah batal demi hukum. Akan tetapi putusan hakim menyatakan bahwa Hartoko melanggar klausul perjanjian kerja persaingan tersebut yang ia tanda tangani sendiri dengan PT. Biggy Cemerlang. Pada penelitian ini, penulis berfokus menganalisa keabsahan klausul larangan bekerja di perusahaan pesaing terkait perlindungan rahasia dagang dengan mengambil contoh pada klausul perjanjian kerahasiaan PT. Biggy Cemerlang.

ABSTRACT
The company is obliged to maintain the secrecy of its information by doing several methods. As long as does not breaks the basic rights of workers. For example, by making undisclosure agreement to make labours keep the confidential information in their companies. But there will be problems, if a company making the rules, example other companies which are similar or the rule which is arrange former labour to work in competitor companies for several period of time. The covenant of that rule is called as non compete agreement. Peoples does not realize that actually their non compete agreement breaks their basic rights of a person to choose a place work. The rights of freedom to choose the place to work have been guaranteed by 1945 constitution of the republic of indonesia (UUD 1945), the act number 39/1999 about human rights, and act number 13/2003 about manpower. At this point, the writer will take the case of the secrecy of PT. Biggy Cemerlang which is one of the secrecy clause of the contents are non compete agreement. In that case, the judge should be more carefully to punish the case that is happened to former workers PT. Biggy Cemerlang, Hartoko, that clause their non compete agreement. But the judges punish said Hartoko has been break the labor agreement clause which is he signed with PT. Biggy Cemerlang. In this research, writer focused to analyze the validity of the clause regarding to the protection of working in one competitor company trade secret by taking the example of the secrecy clause of agreement on PT. Biggy Cemerlang.
