This study addresses two main issues: First, hoe Ministry of State. In the law, the process of selection and appointment of ministers is not regulated at all. It is specifically regulated in the Law of the Ministry of State is the requirement to be a minister. The authority of choosing a minister is attached to the president's authority, inherent power. While involving the Corruption Eradication Commission in the electoral process the minister is not set in legislation, the so-called discretionary or prerogative of the president.

Penelitian ini membahas dua pokok permasalahan: Pertama, bagaimana proses pemilihan dan pengangkatan menteri oleh presiden setelah amandemen Undang-Undang Dasar 1945. Kedua, bagaimana pelibatan Komisi Pemberantasan Korupsi dalam pengangkatan menteri menurut tinjauan Hukum Tata Negara. Metode penelitian yang digunakan adalah yuridis normatif. Pembahasan dimulai dari kekuasaan presiden sebelum dan setelah amandemen Undang-Undang Dasar 1945, khususnya kewenangan dalam memilih dan mengangkat menteri, serta kedudukan Komisi Pemberantasan Korupsi dalam sistem ketatanegaraan Indonesia. Pengaturan proses pemilihan menteri dalam Undang-Undang Dasar 1945 baik sebelum maupun setelah amandemen tidak banyak berubah, dan secara substansi tidak ada yang berubah sama sekali. Meski demikian, setelah amandemen, terdapat undang-undang yang secara khusus mengatur tentang kementerian negara, yaitu Undang-undang Nomor 39 Tahun 2008 tentang Kementerian Negara. Di dalam undang-undang tersebut, proses pemilihan dan pengangkatan menteri tidak diatur sama sekali. Hal yang diatur secara khusus dalam Undang-undang Kementerian Negara adalah persyaratan untuk menjadi seroang menteri. Kewenangan memilih menteri merupakan kewenangan yang melekat pada presiden, inherent power. Sedangkan melibatkan Komisi Pemberantasan Korupsi dalam proses pemilihan menteri tidak diatur dalam peraturan perundang-undangan maka disebutw the process of selection and appointment of ministers by the president after the amendment of the Constitution of 1945. Secondly, how the inclusion of the Corruption Eradication Commission in the appointment of ministers according to a review of Constitutional Law. The method used is juridical-normative. The discussion starts with the president's powers before and after the amendment of the Constitution of 1945, in particular the authority to select and appoint ministers, as well as the position of the Corruption Eradication Commission in the state system of Indonesia. The arrangement of ministerial election process in the Constitution of 1945 both before and after the amendment has not changed much, and substantially no change at all.
