ABSTRAK
Jual beli tanah tanah negara yang telah ditetapkan menjadi tanah objekkonsolidasi kerap terjadi di Denpasar Bali sebagai salah satu kota yang telahberhasil mengimplementasikan kebijakan tanah dalam bentuk konsolidasi tanah.Konsolidasi tanah merupakan sebuah perkembangan konsep dari distribusi tanahyang telah bertahun-tahun diterapkan untuk mengatasi kebutuhan akan lahankosong sejalan dengan meningkatnya populasi masyarakat di Indonesia. Tujuandari konsolidasi tanah adalah untuk mencapai pemanfaatan lahan yang optimal,dengan meningkatkan efisiensi dan produktifitas tata guna tanah, sesuai dengandasar hukum penerapan konsolidasi tanah, yaitu Peraturan Kepala BadanPertanahan Nasional nomor 4 tahun 1991. Permasalahan dalam skripsi ini adalahjual beli tanah konsolidasi (tanah obyek konsolidasi) yang prosedurnya tidaksesuai dengan Hukum Adat Indonesia, yaitu terang, tunai dan riil. Metode yangdigunakan dalam penelitian ini adalah penelitian normative dan tipologi yangdigunakan adalah penelitian explanatory. Hasil penelitian ini menunjukkan dalamjual beli tanah, tidak akan terealisasi transaksi yang bersifat tunai dan riil disertaidengan pemindahan hak atas tanah karena dokumen-dokumen tanah tersebutsedang berada dalam penguasaan BPN sebagai wakil dari pemerintah dalammenjalankan kebijakan pertanahan, untuk mengatur dan mengembalikan kembalikepada pemilik tanah yang asli setelah proyek selesai dan objek jual beli jugamasih samar karena setelah proyek selesai, lokasi tanah yang dikonsolidasi bisaberubah dan luasnya berkurang.

ABSTRACT
Sale and purchase of state land which has been determined as land consolidationobject often occurs in Denpasar Bali as one of the cities that successfullyimplement the land policy in the form of land consolidation. Land consolidation isthe development of the concept of land redistribution that has been done sincemany years ago in Indonesia to address the need for vacant land along with theincrease of population in Indonesia. Land consolidation goal is to achieve optimalutilization of land, through increased efficiency and productivity of land use, inaccordance with the legal basis of the land consolidation implementation,regulation of Chairman of National Land Agency (BPN) number 4 in 1991. Thesubject matter is the sale and purchase of consolidated land (land consolidationobject) which the procedures are not in accordance with the Indonesian customarylaw that has some conditions of sale and purchase of land as follows, namelylight, cash and real. The method used in this research is normative and thetypology used is explanatory research. The result of this research, found that insale and purchase transaction of the land, it won’t be realized a transaction in caseand light accompanied by transfer of land title since the documents of such landare in the possession of National Land Agency / BPN as the representative of thestate in implementing land policy, to be managed and will be redelivered to thereal owner after the project is finish and the object of sale and purchase is notclear yet because when the project is finish, the location of the land that beingconsolidated might be change and the acreage reduced.
