Skripsi ini membahas mengenai konsep hak access to justice sebagai hak asasi yang sangat penting bagi penyandang disabilitas. Hak asasi penyandang disabilitas diatur secara spesifik dalam Convention on the Rights of Persons with Disabilities (CRPD). Selain mengatur mengenai hak asasi penyandang disabilitas, CRPD juga mengatur mengenai ruang lingkup penyandang disabilitas. Pasal 13 konvensi ini mengatur mengenai hak access to justice bagi penyandang disabilitas. Pelaksanaan efektif dari hak ini bagi penyandang disabilitas bergantung pula pada pelaksanaan efektif dari hak asasi terkait access to justice, yaitu hak aksesibilitas, hak atas pendidikan, hak atas pekerjaan, dan hak untuk berpartisipasi dalam bidang politik. Meskipun hak ini sangatlah penting bagi para penyandang disabilitas, sampai saat ini Jepang, Malaysia, dan Indonesia belum memiliki pengaturan yang ditujukan khusus bagi penyandang disabilitas mengenai access to justice.
The focus of this thesis is access to justice concept as a very important right for persons with disabilities. Persons with disabilities? rights are specifically written in Convention on the Rights of Persons with Disabilities (CRPD). This convention also regulates the scope of persons with disabilities. Article 13 of this convention is ensuring access to justice rights for persons with disabilities. Effective access to justice for persons with disabilities also depend on effective implementation of related rights, such as accessibilities, education rights, rights to work and rights to participate in politics. Although this right is very important for persons with disabilities, Japan, Malaysia and Indonesia haven?t regulate this right specifically for them.
