pekerjaantambahpadaKontrakPekerjaanPengadaanBarangdanJasa Life Time
Extention GT 2.1 dan GT 2.2 PLTGU BelawandimanasetelahterjadinyaKontrak,
padasaatPenyediaBarangdanJasabesertaPenggunaBarangdanJasayaituMapna Co.
denganP.T. PLN Perseromelakukan Fact Finding,
merekamenemukanadanyakerusakantambahandimanakerusakantersebuttidaktermasuk
dalampekerjaan yang adadidalamkontrak. PekerjaanTambahtersebut yang
dimasukkankedalam addendum kontrakdianggaptelahmerugikan Negara
dkarenamembuatnilaikontrakmenjadimelebihi HPS yang
telahditetapkanolehPanitiaPengadaan.Hal tersebutlah yang
menjadidasardariJaksaPenuntutUmumuntukmemberikandakwaanbahwaTersangkatela
hmelakukanperbuatan yang merugikan Negara.Dalamskripsiini,
penulisakanmembahasmengenaitanggungjawabdireksisebagaipengurus PT. PLN
Perserodansebagaipihak yang
memberikanpersetujuanataspenetapanpemenangPengadaanBarangdanJasa LTE GT
2.1 dan 2.2 PLTGU Belawan, danapakahbenaradatindakan yang merugikan Negara
dalamkasusini.
ABSTRACT The assumption of loss was driven by the presence of the added work addendum on
the contract of Life Time Extention Goods and Services Job Procurement in Gas
Turbine 2.1 and Gas Turbine 2.2 PLTGU Belawan, where at the PLTGU following
the contract, at the time of providers of goods and services and users of goods and
services that is Mapna co. with PT. Perusahaan Listrik Negara (Persero) doing the
Fact Finding procedure, they found some additional damage where the additional
damage are not included in its work there in contract.Added work the addendum
contract considered to have been included in losses to the state because the additional
work caused by the additional damage make the contract price exceeding the ceiling
price (HPS) that has been made by the committee of procurement.Those things being
the ground of Public Prosecutors to give an indictment that the suspect has been does
an action which losses to the state .In this thesis, writer will talk about the
responsibility of the board of directors as the PT. PLN (Persero) Directors and as the
party that provide the approval to the determination of this procurement winner.
