Tesis ini menganalisis independensi Standby L/C dengan fokus permasalahan pada sifat independensi Standby L/C terhadap fasilitas kredit sindikasi dan pandangan pengadilan terhadap sifat independensi Standby L/C terhadap fasilitas kredit sindikasi. Bentuk penelitian dalam tulisan ini ialah penelitian normatif. Standby L/C mempunyai sifat yang independen sesuai dengan Pasal 4 dan 5 UCP 600 dan Aturan 1.06 dan 1.07 ISP 98. Sesuai dengan sifat independensi Standby L/C maka dalam pelaksanaannya sebagai kontrak tidak boleh dikaitkan dengan pelaksanaan kontrak-kontrak lainnya yang terkait dengan penerbitan Standby L/C tersebut. Permasalahan yang terjadi pada kontrak-kontrak lain tersebut tidak boleh memengaruhi pelaksanaan Standby L/C. Dalam hal terdapat permasalahan dalam perjanjian kredit sindikasi, Standby L/C yang digunakan untuk menjamin pelaksanaan perjanjian kredit tidak boleh diintervensi dengan permasalahan yang terjadi dalam pelaksanaan perjanjian kredit sindikasi itu sendiri. Sifat Independensi Standby L/C terlihat dalam putusan Mahkamah Agung Nomor 1311 K/Pdt/2011 antara Sino Sandjaja dan PT Sedjati Internusa Overseas melawan Kepala Kantor Pelayanan Piutang dan Lelang Negara (KP2LN) Jakarta I, Tbk ex PT. Bank Bumi Daya (Persero) Pusat cq. PT. Bank Mandiri Pusat; serta Bumi Daya International Finance Limited (BDIF) dan juga terhadap kasus dalam Putusan Nomor : 41 / Pdt.G / 2012 / PN.Clp. antara Langdale Profits Limited melawan Gold Coin (C.I.) Limited, PT. Gold Coin Indonesia serta Gold Coin Services Singapore PTE., LTD., PT Panganmas Inti Persada. Dimana dalam dua kasus tersebut hakim berpandangan bahwa permasalahan dalam perjanjian kredit sindikasi tidak memengaruhi independensi Standby L/C.

This thesis analyzed the independence of Standby L/C focussed the problems on the independence principles of Standby L/C against the facility of syndicated loans and the court opinion towards the independence principles on the facility of syndicated loans. Research type in this writing is normative research. Standby L/C owned independence principles according to article 4 and 5 UCP 600 and rules of 1.06 and 1.07 ISP 98. Refer to the independence principles of Standby L/C, their applications as a contract might not be related with others contract applications. Any problems arise with the application of others contracts could not interfere the application of Standby L/C.. Whenever, if the problems comes on the facility of syndicated loans, the utility of Standby L/C for guarantee the application of syndicated loans might not be intervened with the rising problems on the application of syndicated loans itself. The independence principles of Standby L/C shown on the decision of Supreme Court of the Republic of Indonesia No.: 1311/K/Pdt/2011as the case of Sino Sandjaja and PT. Sedjati Internusa Overseas against The Head of State Board Claim and Auction Services (KP2LN) Jakarta I PT Bank Mandiri (Persero) Tbk (the late of PT Bank Bumi Daya (Persero), serta Bumi Daya International Finance Limited (BDIF) and another decision No.: 41/Pdt.G/2012/PN.Clp as the case of Langdale Profits Limited against Gold Coin (C.I.) Limited, PT. Gold Coin Indonesia, Gold Coin Services Singapore PTE., LTD., PT Panganmas Inti Persada. Whereas on above two cases, the judge decided the problems occurred on syndicated loans, it have no influence on the independence principles of standby L/C.
