ABSTRAKAmerika Serikat dikenal sebagai negara yang paling protektif terhadap ancaman perdagangan internasional. Pada kasus ini Indonesia terkena imbas dari sifat protektif tersebut. Hal ini tidak terlepas dari kesadaran Amerika Serikat dalam memproteksi industri dalam negeri mereka. Tercerminkan pada United States Tariff Act of 1930 yang dirumuskan jauh sebelum adanya organisasi perdagangan internasional dan peraturan tersebut terus di amandemen seiring dengan adanya putaran di dalam GATT. Tesis ini mencoba menganalisis penetapan bea masuk antidumping yang dikenakan kepada Indonesia pada tahun 2010 berdasarkan perbandingan antara undang-undang Amerika Serikat dengan Agreement on Implementation of Article VI of The General Agreement on Tariffs And Trade 1994 (ADA) yang merupakan perjanjian internasional yang mengatur tentang penerapan antidumping ditingkat perdagangan internasional.
ABSTRACTUnited States is known to be the most protective country to the threat of international tread. In this particular case, Indonesia is a affected by United States protectiveness. It is due to the concern of the United States to protect its domestic industry. It is reflected in the United States Tariff Act of 1930 that was codified way before the establishment of international trade organization; and that Act was continuously amended, as the GATT rounds persist. This thesis tries to analyze the imposition of antidumping duties to Indonesia that was occurred in 2010, by comparing the United States’ Act with the Agreement on Implementation of Article VI of The General Agreement on Tariffs and Trade 1994 (ADA) which is an international treaty that governs the imposition of antidumping measure in international level, United States is known to be the most protective country to the threat of international tread.
