[ABSTRAKTugas Karya Akhir ini akan menjelaskan dan menganalisis kasus anak dengan disabilitas fisik yang ditolak di sekolah periode sebelum 2011 dan setelahnya. Dalam penulisan ini, bentuk diskriminasi yang ditemukan akan dikaji menggunakan konsep state crime. Hasil penulisan ini menemukan bahwa negara terbukti telah melakukan state crime, karena telah mengabaikan hak anak dengan disabilitas serta melanggar undang-undang internasional dan nasional. Seharusnya negara dapat menjamin hak anak dengan disabilitas dalam undang-undang CRPD. Sehingga inklusif yang dijamin dalam UU CRPD, yaitu dengan prinsipnya non-diskriminasi, dapat berjalan dengan baik di Indonesia.

ABSTRACTThe Concern of this study is to attempt explaining and examining the cases of children with disabilities, this major case examine about children with physical disabilities those got no chances to attending reguler school previously at 2012 ? 2014. In this study, the form of discrimination those found will analyzed by the concept of state crime.
