Tesis ini membahas mengenai pendaftaran jaminan fidusia secara elektronik bagi tanggung jawab Notaris dan perlindungan kreditur pemegang jaminan fidusia. Pasal 11 ayat 1 Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia mengatur bahwa Jaminan Fidusia wajib didaftarkan. Pendaftaran Jaminan Fidusia merupakan hal yang sangat penting untuk menjamin kedudukan kreditur. Peraturan Pemerintah Nomor 21 Tahun 2015 mengatur suatu pendaftaran jaminan fidusia secara elektronik yang diusulkan oleh Kementerian Hukum dan Hak Asasi Manusia untuk mengatasi kelemahan dalam pendaftaran jaminan fidusia secara manual yang diadakan sebelum tahun 2013. Namun peraturan pemerintah nomor 21 tahun 2015 tersebut masih memilili beberapa kelemahan seperti tidak diaturnya kewenangan Notaris pendaftaran jaminan fidusia secara elektronik padahal peran Notaris sangat penting karena akses pendaftaran jaminan fidusia secara elektronik diserahkan hanya kepada Notaris. Tidak diaturnya peran Notaris tentunya mengakibatkan tidak diaturnya tanggung jawab yang tepat bagi Notaris apabila melakukan kesalahan dalam melakukan pendaftaran. Selain itu program pendaftaran jaminan fidusia secara elektronik yang diciptakan belum mampu memberikan perlindungan bagi kreditur karena belum dapat secara otomatis memblokir pendaftaran jaminan fidusia yang kedua kali atau fidusia ulang. Penelitian tesis ini bertujuan untuk mengetahui kewenangan dan tanggung jawab Notaris dan sejauh apa perlindungan bagi kreditur dalam melakukan pendaftaran jaminan fidusia secara elektronik. Penelitian tesis ini merupakan penelitian hukum normatif yang bersifat ekspalanatoris. Jenis data yang digunakan adalah data sekunder.

This thesis discuss about the electronic registration of Fiduciary for the responsibiity of the Notary and the protection for the creditors as fiduciary holder. Article 11 Paragraph 1 Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia regulates that fiduciary is oblged to be registered. The registration of fiduciary is a very important act to guarantee the position of the creditors. Peraturan Pemerintah Nomor 21 Tahun 2015 regulates for the fiduciary registration electronically which was the idea of the Ministry of Law and Human Rights to overcome the weakness in the fiduciary registration that was done manually which was done before 2013. But Peraturan Pemerintah Nomor 21 Tahun 2015 still have some weaknesses such as the lack in regulations about the responsibility of Notary in the electronic Registration of Fiduciary even though the role of Notary is very important because the access to electronic registration of Fiduciary was given only to the Notary. The exclusion of Notary role in the regulation caused the exclusion of the responsibility of the Notary if they made mistakes in the registration process. In addition the programme of electronic Fiduciary registration that was created has not been able to provide the protection for the creditors because it can not otomatically block secondary fiduciary registration or repetitive fiduciary. The purpose of this thesis are to know the competence and responsibility of Notary and how far it protects the creditors who use electronic fiduciary registration. This thesis is a normative legal research which are explanatory. The kind of data used is secondary data.
