ABSTRAKAnak sangat rentan menjadi korban kejahatan khususnya korban kesusilaan. Anak yang menjadi korban kejahatan kesusilaan tentu tidak hanya menderita secara fisik tetapi juga psikis. Namun, dalam proses peradilan pidana, kedudukannya sebagai korban cenderung terpinggirkan. Melihat perlindungan dan kedudukan anak sebagai korban kejahatan yang belum terlalu diperhatikan dalam proses peradilan pidana, pendekatan keadilan restoratif dipergunakan sebagai model alternatif penanganan perkara anak yang dinilai lebih mampu menjamin perlindungan dan kedudukan anak sebagai korban kejahatan. Penulis menggunakan tipe penelitian normatif yuridis. Pada penelitian normatif, penulis menggunakan pendekatan undang-undang dan pendekatan kasus Sedangkan secara yuridis, penulis melakukan wawancara terhadap Penyidik Anak, Penuntut Umum Anak, dan Hakim Anak terkait pengetahuannya mengenai sistem peradilan pidana anak.Hasil penelitian dapat diperoleh kesimpulan sebagai berikut: (1) penanganan perkara anak dengan model pendekatan restorative justice nyatanya belum mampu memberikan perlindungan terhadap anak korban kejahatan apabila dibandingkan dengan mekanisme peradilan konvensional (2) aparat penegak hukum dalam menjalankan perannya belum begitu menjamin perlindungan terhadap anak korban (3) sistem peradilan pidana anak seharusnya kedepan mampu memperhatikan kepentingan dan perlindungan tidak hanya untuk anak pelaku, tetapi juga untuk anak korban dan anak saksi.

ABSTRACT

Children are surely vulnerable to be the victims of crimes, especially victims of criminal acts of decency. The children who are being the victims of criminal acts of decency are not only suffer physically but also psychologically. However, in the criminal justice system, their positions as victims tend to be marginalized. Seeing the child?s protection and status as a victim of crime has not been paid too much attention in the criminal justice system, restorative justice approach is used as an alternative model of handling the case of children, which is considered as more capable of guaranteeing the protection and status of children as victims of crime. The author uses normative juridical research. In the normative research, the authors uses the statute approach and use the case approach. In the juridical research, the author conducted the interview with police, prosecutor, and judge related to their knowledge of the criminal justice system of children.

Results of the study can be concluded as follows: (1) Handling the case of the children with restorative justice approach in fact has not been able to provide protection to child as victims of crime when compared to the conventional criminal justice system mechanism. (2) The law enforcers in carrying out their role have not been fully guaranteed the protection of the child as victims. (3) the criminal justice system of children should be able to observe the concerns and the protection.
