This study discussed a divorce based on religious court decision concerning with legal consideration, judicial conclusion, and legal consequence results of study described that the plaintiff petition was justified because of court competence and in comformity with the law. Judicial conclusion with absence of respondent (verstek) broke their marriage by fasakh, and case fee burdened to the plaintiff. Legal consequences of the divorce for the exwife that was a free widow without child and common property with a waiting time (iddah).
