When we talk about consumer protection (especially in Indonesia), it must be recognized that there's imbalance relationship between producer and consumer. In this regard, by and large, consumer has not good position when he will sue for damages caused by producer's negligence. Meanwhile, Indonesia has no good legal system concerning whit that issue. In the interest of consumer protection. It mus be considered to adopt strict liability principle especially relating to product liability. By applying strict liability principle , it can be expected that consumer has no obstacles to prove producer's negligence. Based upon this principle producers have to liable for damages caused by their defective product. Relating to applying that principle, the existing of Indonesian Consumer Protection act is absolutely required.
