Dalam Pasal 43 ayat (1) Undang-Undang Perkawinan dan Pasal 100 KHI menyatakan bahwa anak hasil perkawinan sirri hanya memiliki hubungan hukum perdata dengan ibu dan keluarga ibunya, naum Pasal 34 ayat (1) Undang-Undang Perkawinan dan Pasal 77 sampai dengan Pasal 81 KHI menyatakan bahwa yang bertanggung jawab untuk menafkahi keluarga adalah ayahnya, sehingga melalui Putusan Mahkamah Konstitusi No.46/PUU-VIII/2010 diubahlah cara membaca Pasal 43 ayat (1) Undang-Undang Perkawinan dimana suami dapat dimintakan pertanggung jawaban apabila dapat dibuktikan dengan perkembangan tekonologi. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach), dan pendekatan kasus (case approach). Oleh karena itu tujuan diadakannya penelitian ini adalah untuk melihat efektivitas dari putusan yang dikeluarkan MK perihal tanggung jawab orang tua terhadap anak hasil perkawinan sirri. Berdasarkan hasil penelitian, dapat disimpulkan, Putusan yang dikeluarkan MK tidak berdampak langsung karena tidak berkesinambungan dengan undang-undang lain yang terkait dan tidak terdapat sanksi apabila tidak dijalankan.

In Article 43, paragraph (1) of the Marriage Act and Article 100 of Islamic Law Compilation said that the children of Sirri marriage only have the relationship of civil law with the mother and her family, while in Article 34 paragraph (1) of the Marriage Act and Article 77 through Article 81 of Islamic Law Compilation states that are responsible for feeding their families is the father, so that through the Constitutional court Decision No.46 / PUU-VIII / 2010 it changes how to read Article 43, paragraph (1) of the Marriage Act which the husband should be held accountable when it can be proved with technological developments. Therefore the aim of this study was to look at the effectiveness of the decision issued by the Court concerning the responsibility of parents to children of Sirri marriage. This research is a normative approach to law (statute approach), and the case (case approach). Based on the results, it can be concluded, the Court issued Decision no direct impact as not sustainable with other law-related and there are no sanctions if it does not run, so it is difficult to apply.
