 Abstract

Persaingan Usaha dan Hukum Kekayaan Intelektual. Hubungan ini dapat dilihat dari berbagai perspektif, salah satunya adalah prespektif ekonomi dari hukum. Dikarenakan kedua sector hukum memiliki peran yang penting dalam sistem perekonomian, tentunya keduanya akan bersinggungan dalam praktek. Pada dasarnya, Hukum Kekayaan Intelektual memberikan hak ekslusif untuk memonopoli dan mengeksploitasi karya seorang pemegang hak dan berdasarkan hak tersebut seseorang dapat mentrasfer hak mereka melalui Perjanjian Lisensi. Pada umumnya, ada dua tipe Perjanjian Lisensi, yakni: Lisensi wajib dan Lisensi kontraktual. Lisensi Wajib adalah lisensi yang mengimplementasi Hak Kekayaan Intelectual yang telah ditetapkan berdasarkan putusan Direktorat Jeneral melalui pendaftaran, sedangkan Lisensi Kontraktual adalah lisensi yang dilakukan berdasarkan hokum perjanjian antara pemberi lisensi dan penerima lisensi. Lisensi Kontraktual ini terdiri atas lisensi eksklusif, non-ekslusif, dan lisensi silang. Lisensi-lisensi tersebut dapat dinilai melalui Hukum Persaingan Usaha mengenai kesehatan persaingannya terhadap kompeititor-kompetitor lain pada pasar. Maka, timbul isu mengenai apa lisensi tersebut dapat mengakibatkan persaingan tidak sehat pada pasar.

This thesis is an analysis regarding the relationship between Competition Law and Intellectual Property law. This relationship can be seen from many perspectives, one of them being the economic perspective of the law. As both sectors of law have an important role in the economic system, surely the two may intersect in practice. In its essence, Intellectual Property Law gives the right to monopolise and exploit one's creation and by virtue of this right one may be able to transfer his/her Intellectual Property Right to another by way of a License Agreement. Generally, there are two types of License Agreements, namely: compulsory licenses and contractual licenses. A compulsory license is a license that implements an Intellectual Property Right which has been granted on the basis of a decision by the Directorate General via application, whereas a Contractual License is a license done on a basis of Contract Law between the Licensor and Licensee. Furthermore, Contractual Licenses comprises of exclusive, non-exclusive, and cross licenses. Such licenses can be assessed by means of Competition Law to review its pro-competitiveness against the right holder's business competitors. Thus, an issue of whether said licenses may impose anti-competitive effects towards the market rises.
