Problem occurs when there are some creditors and in fact debtor breaches the contact or goes bankrupt. The holder of mortgage guarantee has a right called "separatis", right given by law to creditor that collateral good encumbered with mortgage is not part of bankrupt asset, so creditor has a right to execute it bassed on self-authority given by mortgage law, however, Bankruptcy Law disobeys the "separatis: right so it raises inconsistency, where right of the mortgage holder disobeyed.
