ABSTRAKPengadaan infrastruktur di Indonesia saat ini telah menggunakan skema Kerjasama Pemerintah Dengan Badan Usaha KPBU di mana di sini Pemerintah bekerjasama dengan Badan Usaha dalam rangka penyediaan infrastruktur untuk kepentingan umum. Dalam skema KPBU di kenal suatu pengajuan proyek dengan prakarsa Badan Usaha di mana proyek tersebut tidak termasuk kedalam Rencana Induk Pemerintah, yang disebut sebagai Unsolicited Project. Dalam Unsolicited Project, dikenal suatu pemberian kompensasi terhadap Badan Usaha pemrakarsa yang salah satunya adalah pemberian Hak Untuk Menyamai Penawaran Terbaik Right to Match . Penelitian ini bertujuan untuk mengetahui bagaimana praktik Right to Match saat ini dan bagaimana pengaturan hukum di Indonesia berkaitan dengan Right to Match dalam skema KPBU, serta permasalahan-permasalahan apa yang umum terjadi berkaitan dengan Right to Match didalam skema KPBU dan bagaimana cara mengatasinya. Penelitian ini adalah penelitian yuridis normatif dengan deskriptif. Hasil penelitian ini menyarankan agar pembagian tanggung jawab risiko dalam skema KPBU diberikan kepada pihak yang dianggap paling bisa mengelolanya, dan Pemerintah dalam memberikan kompensasi Right to Match lebih melakukan pengawasan agar Badan Usaha tidak menerima keuntungan yang dapat merugikan masyarakat sebagai calon pengguna infrastruktur.

ABSTRACTInfrastructure provision in Indonesia right now has adopted the Public Private Partnership PPP scheme where Government is in cooperation with private sector to build an infrastructure for public interest. In PPP scheme there is a project called Unsolicited Project in which the projects are not requested by Government or not in the Government rsquo s Master Plan and usually originate from the private sector. In an Unsolicited Project, the private sector as proponent can receive an advantages, one of which is The Right to Bid by The Initiating Business Entity In Relation With The Best Bidder Right to Match . This research aims to determine the current practice of Right to Match, how the legal arrangement in Indonesia relating to the Right to Match in PPP scheme, and the problems relating to the Right to Match in PPP scheme and how to handle it. This research is normative with descriptive. The result of this research suggest to allocate the risk in PPP scheme to those deemed most able to manage it, and Government in providing the Right to Match compensation to do more supervision to the private sector so they don rsquo t receive benefits that can do harm to the communities as users of infrastructure.
