ABSTRAKPenelitian ini membahas tentang kesesuaian konsep BUT dalam dunia ekonomi digital. Tujuan penelitian ini adalah untuk mengetahui i apakah penerapan konsep BUT tersebut berkontribusi bagi tergerusnya basis pendapatan pajak, ii apakah konsep BUT yang berlaku di Indonesia sudah mampu menjawab tantangan perpajakan ekonomi digital, dan iii apakah konsep BUT saat ini masih sesuai untuk menentukan hak pemajakan atas aktivitas-aktivitas ekonomi digital atau membutuhkan modifikasi. Penelitian ini merupakan penelitian kualitatif dengan menggunakan pendekatan kepustakaan. Hasil penelitian menyimpulkan bahwa konsep BUT saat ini tidak sesuai lagi untuk digunakan dalam menentukan hak pemajakan negara sumber dalam dunia ekonomi digital, bahkan berkontribusi dalam mengikis basis pajak di negara tersebut. Konsep BUT di Indonesia juga belum mampu menjawab tantangan ekonomi digital. Dengan demikian penelitian ini menyarankan agar konsep BUT dimodifikasi atau menerapkan mekanisme pemajakan yang lain khusus atas ekonomi digital.

ABSTRACTThis research discusses the relevance of permanent establishment concepts in digital economy to identify if i the application of permanent establishment concepts contribute to the loss of the basic income from tax ii the permanent establishment concepts currently applied in Indonesia are effective to deal with the challenges encountered in digital economy taxation iii the currently applicable permanent establishment concepts are still relevant to define the right to tax digital economy activities or require ammendment. This research is a qualitative research based on literary analysis on secondary data. The output of this research suggests that the currently applied permanent establishment concepts is no longer relevant to determine the source country 39 s right to tax the digital economy activities and, therefore, contributes to the loss of bases tax in the country. The permanent establishment concepts is also not effective to deal with the challenges encountered in digital economy. Hence, this research recommends that the government ammends the permanent establishment concepts or apply alternative tax mechanism, specifically for digital economy.
