Skripsi ini menganalisis mengenai tindakan anti persaingan yang menyebabkan tingginya tarif angkutan peti kemas Batam-Singapura dengan menggunakan metode penelitian yuridis normatif. Pada awalnya, Komisi Pengawas Persaingan Usaha KPPU menduga bahwa tingginya tarif angkutan peti kemas Batam-Singapura yang ditetapkan oleh sejumlah perusahaan Singapura merupakan kartel yang dilarang oleh Pasal 11 Undang-Undang Nomor 5 Tahun 1999. Akan tetapi, tindakan anti persaingan yang secara substansial lebih tepat dalam kasus tarif angkutan peti kemas Batam-Singapura adalah penetapan harga yang dilarang oleh Pasal 5 Undang-Undang Nomor 5 Tahun 1999 karena dalam kasus ini tidak terdapat pengaturan produksi atau pemasaran. Selanjutnya, perusahaan Singapura yang terlibat dalam kasus penetapan harga tersebut bukanlah merupakan pelaku usaha yang didirikan dan berkedudukan atau melakukan kegiatan dalam wilayah hukum Indonesia, sehingga Undang-Undang Nomor 5 Tahun 1999 tidak dapat berlaku secara optimal dan efektif terhadap kasus tersebut. Skripsi ini juga membahas mengenai keberlakuan UU Nomor 5 Tahun 1999 untuk diterapkan secara ekstrateritorial terhadap tindakan anti persaingan yang bersifat lintas negara dengan mempertimbangkan doktrin-doktrin hukum persaingan usaha yang ada di berbagai negara. Dalam menindaklanjuti kasus ini, sangat diperlukan adanya amandemen terhadap UU Nomor 5 Tahun 1999, sehingga Undang-Undang Nomor 5 Tahun 1999 dapat berlaku secara optimal pada tindakan anti persaingan yang membutuhkan penerapan hukum persaingan usaha ekstrateritorial.

This thesis analyzes problems related to alleged cross border anti competitive conduct on container liner shipping price between Batam Singapore that had been fixed by the Singapore entities using juridical normative methodology. In this case, Competition Comission of Indonesia Komisi Pengawas Persaingan Usaha or KPPU alleged that expensive rate of the container liner shipping price is considered as cartel prohibited by the Article 11 of the Law Number 5 of 1999. However, it rsquo s more proper to consider the expensive rate of the container liner shipping price is substantially caused by price fixing that is prohibited by Article 5 of the Law Number 5 of 1999 because there is no evidence that the Singapore entities had determined the production and marketing of the product. Moreover, the Singapore entities involved in this case are not undertakings that established, located, or conducting action in the teritorial jurisdiction of Indonesia, and therefore the Law Number 5 of 1999 can not be applied toward them effectively and optimally. This thesis also examines the enforceability of the Law Number 5 of 1999 to be applied extraterritorially against cross border anti competitive conduct by considering competition law doctrines used in various countries. In this case, the amendement of Law Number 5 of 1999 will truly support the Indonesia rsquo s competition law to be applied extraterritorially in the most effective and optimal way.
